I had one of those, a few years back when i protested to my local council over poor bin collection service. Some days the binmen don't turn up and so i told the council that as a result of the limited service, i will not be paying the full tax amount. But of course, once they started legal proceedings, i have no alternative but to pay!!

Great for the so called democracy here in UK!!

Hmmm, so what am I supposed to do with it other than put it through the shredder mate? Ooops, too late - already shredded it! I'll go to prison in protest - i'm not paying - simple.

Everything is fine with HSBC mate - still have 2 full accounts and credit card..... but that's it. No more and no more borrowing allowed! What annoyed me most was this was done at the credit card 6 month limit review - so no increase, instead they dropped the limit for me - nice of them!

That was almost 6 months ago so hoping in April my overdraft facility lets me amend it - If not i'll start using my Covernty First and BoC accounts and ditch HSBC.... their loss.

Do you still think they're the best bank? Or after your recent experience have you changed your opinion?

Course they are the best bank - mate, I fully understand what they are doing but I refuse to give up time to go into a branch to prove my innocence. If they think I am guilty then they can come to me (and then i'll prove em wrong).....

NID CCA when with a collections dept can they refuse to written contracts at all.

I have had this spiel from LloydsTSB and have rather contemplated whether its true or false.

"I note that you are disputing the balance of the account and have previously requested a written contract before agreeing to any repayment plans with us. Our Collections Centre has advised we do not provide these. This is because the Consumer Credit Act 1974 does not require these agreements to be documented in"executed agreements" within the meaning of the act."

Say what mate? Are you saying you've formally requested the CCA and they refused you?

The actual letter you send is this and you need to send £1 as well: CCA Request

If you're having issues mate head over here: Unenforceability & Template Letters III

Or am I reading this wrong, and really you want them to send you paperwork agreeing to a repayment plan so you have documentary evidence?
