I commited fraud in fake names at my address and other addresses what happens now. will i go to jail?
I commited fraud in fake names at my address and other addresses in my flats what happens now. will i go to jail?
It all happened because i am young and stupid, it has ran over 2 and a half years. It was just easy to do. Everytime i applied for an account it was accepted with £125 credit limit so just kept on doing it and it made xmas and birthdays and even gettin myself clothing so much easier. I could not afford anything of this otherwsise because i was in so much debt with my rent and utility bills as well as a loan shark. I use to sell the stuff i got for free from the catalogue to make money to live
There was never any credit agreements to sign, it was that simple it became an obsession.
i feel like ending my life as i cant tell anyone, i live alone and it was so stupid of me to get out of control.
i have had depression and it was all that made me feel better.
I went bankrupt in january 2009 but didnt include all of this fraud items into my bankruptcy and have been on the straight and narrow since. I have never signed any credit agreements for this stuff, but it is still fraud.
what happens now as the company have just found out and the company are looking for restitution under the fraud act 2006
They say there is 10 grand of debt but 4 grand of it is fraud (other peoples addresses)
what does this mean?
am i going to jail?
please help
im so alone

"looking for restitution" sounds like they want you to pay the money back
- has anyone mentioned criminal proceedings?
Have you admitted to the fraud already?0 -
hi can i PM you?0
-
Call the CAB - what happens will depend on if you can repay or not and what action the companies will take and if they report it to the police or not. I'm sorry but there is no way of saying "don't worry - it'll all be ok" because I don't think anyone can promise that... You need legal council right now - not debt advice.DFW Nerd #025DFW no more! My DFW Diary - blah- mildly funny stuff about my journey0 -
yup you can - not that i know much about the law in these cases, but just going on the language, it sounds like they want their money back! ETA - I agree with MrsT about speaking to the CAB asap!
PS - it is certainly not worth ending your life over, although I can understand you must feel very very worried indeed - you may want to ralk to the Samaritans, just offloading can really help!

Hi,
I can't condone what you have done but equally "let those without sin cast the first stone" etc etc
If you can come to a repayment arrangement with the catalouge companies then great that's the obvious answer but if you can't then I think you will have little choice but to wait and see what they do next.
Look we all do stupid stuff from time to time. I think you do need to take proper legal advice on this if it progresses to a complaint of fraud/theft.
Are you entitled to legal aid? If you are not sure try and find out probably via CAB as others have suggested.
Being in trouble is no reason to end your life that won't solve a great deal other than causing those left behind a life time of regret and sorrow so please don't go thinking like that.If you really are feeling suicidal then please pick up the phone and dial up the Samaritans.
Have the catalouge companies made any mention of reporting this to the Police?
If they have or are going to here is my take on it.
If you have not been in trouble for criminal matters previously or even if you have and they were of a minor nature I think it highly unlikely that you will go to prison.
If you are a persistant offender which I doubt then it might be a different story
There will be some sort of punishment or sanction but the law/ courts have loads of methods at their disposal to deal with these types of matters.
At the lowest end of the scale would be a Police Caution and at the worst a Custodial Sentance.
It's a massive spectrum inbetween those two and although I can't promise you what the outcome will ultimately be experience would suggest some sort of community based punishment would be likely in the circumstances assuming it ever got as far as court.
e.g Community Service of XXX amount of hours.
Look my advice would be this. It has caught up with you. You know you did wrong and you seem genuinely remorseful and that is to your credit.
The right thing to do is admit to what you have done face the consequences learn from it and move on with your life.
Sure it will be a horrible time for you but nothing lasts forever and you will be out the other end before you know it.0 -
sorry to be blunt but in the eyes of the law you do deserve to go to prisonbubbles1000 wrote: »I commited fraud in fake names at my address and other addresses what happens now. will i go to jail?

but there would be an invetigation and you could possibly get of with a caution if youre arrested
even if you were charged the judge may give you a suspended sentence or a coditional dishcarge
my advice is to seek legal advice and contact your local police station before the company do the police may be lenient on youReplies to posts are always welcome, If I have made a mistake in the post, I am human, tell me nicely and it will be corrected. If your reply cannot be nice, has an underlying issue, or you believe that you are God, please post in another forum. Thank you0 -

Poor advice
The first step is to negotiate/beg/plead with whoevere the op owes the money to, take it from there , the police really have got better things to be doing...if the companys go to the police then fair enough...worry about that side of things then...
And who are you to say "sorry to be blunt but in the eyes of the law you do deserve to go to prison "
You know little of the real facts on the matter and should refrain from posting if that`s your `advice`0 -
The worst part is over. Now that it is in the open you have to focus on the good things in life. Birds singing, children playing, the sun, the rain, anything that makes you smile.
Get all the dark thoughts out of your head. Speak to your GP if necessary.
As for paying them back, make an offer based on what you can reasonably afford - but only after speaking to CAB.
Be happy. What's the worst that can happen?
GGThere are 10 types of people in this world. Those who understand binary and those that don't.0 -
Well said GG - Get in touch with the Citezens Advice Bureau ASAP
They may not be able to help directly but one probably free chat with a solicitor who can advise you on the next steps may well sort you out.
You have taken the first step by realising that it has come back to bite you. Good luck and get rid of any "dark" thoughts soonest!0 -
thanks all
i have called the guy who sent me and email saying i owed 10 thousand pounds- he said that as im bankrupt (as of january this year) he could have it prevoked, he said he could call the police.... he wants me to pay £400 by 14 days and apologise to the neighbours or he will prosecute me..
i was in tears on the phone, i was admitting all i done wrong, he didnt even want to hear why i did it.0
