This is nuts:
If that is exactly how the invoice is:
You have agreed to buy the car cash for £10,500
And they have agreed to sell it for £10,500 cash.
Their mistake.
However you have agreed to sell them you car for £0.
Although neither of you have signed it, so I believe contractually the agreed price is what the salesman accepted at the time of purchase e.g. £500 deposit, £8000 balance and a part exchange. Unless there is a order form (signed by both parties) that states otherwise.
Right old mess.0 -
I know! Struggling to get my head around all of this.
I didnt realise until now how much of a mess the paper work is.0 -
Have you spoken to the bank/credit card company today?Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0

Did they give you a order form when you originally left the deposit for the car?
Also i presume they have your old car now?0 -

They are not allowed to take the extra £2,000 without your authorisation. You need to ring your credit card company and inform them that this money has not been authorised so should be refunded.
If the invoice said £10,500, then that is what they were selling the car to you for. You paid £500, so therefore owed them £10,000. You had already agreed to pay part of the balance with your scrappage car, which reduces the balance to £8,000. You paid this as agreed.
As far as I can see, you have paid in full for the car as agreed on paper. It is not unreasonable to be given a discount on the book price. I mystery shop car dealers and regularly get discounts of up to £4,000 on new cars. You agreed a price. They accepted your old car as part of the cost and have now scrapped it! I don't think you have done anything underhand. It is definitely underhand of them to illegally take more money from the credit card details that they have copies of. You have to give explicit consent for any further transactions, you have not so therefore they have effectively taken this money fraudulently.0 -
yes we have had bank card cancelled now and they are going to send out forms to get the money sent back to my account...I hope.0

That's good. Have you actually got the new car yet?0
-
