Fixed Penalty fine for dog fouling

Hi Guys, it's been a while since I've last logged on! I could do with some help today. In a nut shell my father has been fined for failing to pick up dog faeces when walking my dog. It's debatable whether it was in fact my dog who made the mess but my father picked it up anyway, he was prepared with poop scoop bags, and was then slapped with a fine, the spelling of his name was wrong and no id was shown to him, the guys who fined him simply pointed to their uniforms and badges. Needless to say the council wont listen to my argument about my father being prepared and not even aware the dog had done anything and are now threatening us with court action. I know I'm probably on the wrong forum here, but I'm hoping someone can point me in the right direction on how to contest the fine. :mad:

write to them contesting the fine......

if they deny it i say suck it up and pay. not worth court action.

there's something a bit 'off' about your description of events.

If your father picked up the dog mess, why did they still issue him with a fine?

Because they say he walked away from the mess in the first instance and they had to point it out to him, remember my dad didn't realise she had done any other than urinate!

I have written, to no avail. On a point of principle I dont want to pay, the men were rude and intimidating and I'm almost sure it wasn't my dogs mess, she had been to the loo befor he took her out!

Not realising the dog fouled is not an excuse. I'd pay up as there are two of them. Even if there was just one of them, their word would be taken over your Dads.

It might be advisable to be a bit more decisive if you do contest the charge.

i would pay up too

its a fight you wont win im afraid

or you could drag it out in court in a matter of principle and then end up paying the fine, plus whatever else they want to add on, oh and court fees.

The notice that he has received will tell him how to appeal it. Follow the instruction on there.

Presumably, your father has retained the evidence, so that tests can be carried out to prove it wasn't his dog's poo? I would have done, if it had been me.

Anyway - the FPN is presumably addressed to your father, so it's not your problem.

You might have done with the intention of doing it. But I can only imagine a DNA check is not cheap and oaying the fine grudgingly will be the most expediant option. Bummer if you paid to have it tested and it was your dog's!...ouch.

As has been pointed out by Mummy OP isn't even convinced.

But I am surprised that when it wasn't picked up the OP's father wasn't just given a stern ticking off!

the guy's issuing the ticket would have been damn sure it was your dogs mess,and I wish there were more of them about:j,at least he only got a fine,If I see someone walk off I follow them to the house then go back get the [EMAIL="s@it"]s@it[/EMAIL] and pop it in a paded envelope and post through their door:rotfl:
