I know you have asked for help on how to appeal but I have to say I really do not think you should appeal. Its a complete waste of taxpayer's money. I am afraid when you write that you will now have 9 points on your licence then its a bit naive of you to say you don't want comments about it being your fault. Speeding is a touchy subject and will always provoke a heated debate. So my tip would be not to appeal. I am not trying to be hostile to you (honest) just saying what I think you should do.0 -

I really don't think for a minute that you were driving like a loony and I am sure you were just unlucky getting the other 6 points - I was just trying to help by saying I think you would be wasting time and money contesting it.0 -

i agree with your views but since you were caught speeding id accept the point and be wary, if its a housing estate the limit is 30mph,No Links in Signature by site rules - MSE Forum Team 20 -
So travelling at 30.1mph kills wherease 29.9 doesn't, even if in the latter case the driver is on the phone arguing with their wife whilst looking at their sat nav whilst in the former the driver is concentrating on the road?Speeding kills. Simple. Pay up and stop moaning.

The fact that the OP has stated that the new points will take him to 9 in total indicates he has done this before. Your points regarding the driver talking on the his mobile & looking at sat nav. are irrelevant in this case. The OP was speeding and got caught. Speeding does kill. We only have the OP's word that he wasn't going that fast. Perhaps this will be awake up call for him/her.
EDIT: It should also be noted that the OP states that the speed was actually 42 MPH, which is 12 MPH over the speed limit. Not 1 MPH.0 -

I sympathise to some extent.
The Association of Chief Police Officers guidelines suggest an allowance of 10% + 1 which would indicate that they believe, in a 30mph zone, 34mph is not dangerous but 35mph is (or 34.9 and 35.0 if you like). Some areas adopt this guideline as policy, others allow 10% + 4mph. Some may not allow any leeway.
This is the problem IMO. Drivers do not know where they stand. Is it 30, 34 or 38 mph that I'm allowed. My speedo probably reads 10% high so is it an indicated speed of 33, 37 or 41 mph that I'm allowed?
Speeding does not kill. Dangerous driving (which could include excessive speed) kills. Driving at 30mph past a school in the fog at 4pm on a school day is dangerous (excessive speed). Driving past the same school at 4am on a Sunday at 31mph is not dangerous driving but could land you with 3 points and a £60 fine.
Cameras mean less traffic police - fact. Less traffic police means other offences that cameras cannot detect go unpunished. This is why the accident rates do not drop in proportion to the number of cameras that are installed. They just don't work as well as people may believe.

With respect - that's !!!!!! ! It's what we are being told on the telly and ads but it is all tosh. Speed does not kill. No one EVER had an accident just because they were going fast. Not making allowances for road conditions, poor observation, driving too close, etc. are all things that cause accidents. Of course it is 'easier' to drive more safely when going slower but you don't 'have' to drive slow to be safe. A good experienced motorist can go well above the speed limit in the right conditions and still be a lot safer that 90 year old 'Granny' in her Micra teetering along at 25mph, BUT - she can't see further than her wipers ! Or boy racer in his Subaru WRX that has no respect for other road users and just wants to show off his 350+bhp to his mates.

Wobbley if I could click the thanks I would! What you say is the sensible arguement. I find roads far more dangerous now especially if I don't know where I'm going as I have to pay more attention to the speed limit signs and for speed cameras then before. What happened to the rule that x type of road with houses near was x speed limit. If the houses were further off the road and there was something inbetween it was x speed limit. We recently had a 50 changed to a 30 - after driving the road for years sometimes you do forget that they have changed the limit and people slam on causing accidents....it's not the speed that causes them it's the stopping!!
edited to add, my support is with the OP - although I don't know if you can successfully appeal it, but if you google speed cameras you'll find sites that may help.
