if the case has been heard can we have the name of the court it was heard in and the judge making the ruling? then i can find the info and take the fishy smell off the posts ;)

(i am genuinely interested in what this judgement says - might manage to take a few folk to court soon!)

I found your posts fishy because they were posted by a Sole. No form of humour is too low for me ...

  • Caveat Temptor = Let the buyer beware ! i understand your plight, however the fitter did nothing wrong. Without trade account holders Howdens would go bust in a year,Howdens need to offer discounts to builders to win their buisiness. As a builder with competition from non british tradesman, more than ever we need a material mark up to stay in business.

If the fitter did nothing wrong he wouldn't have been taken to court and the judge would have dismissed the case! Judges I think are more qualified than you!

And no it won't be another two years - it took me 17 months to get it to Court as the builder kept failing to provide info and other matters, there was more than one hearing! And I didnt have to come back on here.....

Given the reaction I am having from some posters I almost regret coming back on here, had wanted to provide encouragement to any other customer who was conned by a builder.

all that everyone wants to see is the facts here - you have constantly failed to provide any, if you want to encourage people you should post actual fact otherwise no one can tell exactly what the case you have is, this obviously wasn't a good time to come back to post your result as you won't release any of the factual information of your case - i would suggest that when you feel this is appropriate, you should set yourself up a website with all the details as no doubt it will be of great interest

You really don't understand, i have been advised not to post the judgement details which you have asked me for SEVERAL times.

Patience cleary is a virtue that you have not been blessed with.

Give me a nudge in a couple of years then when you get round to making up the next part of this story.

The issue is not that fitters get a trade discount. The issue is making false claims. What the fitter did was say he would supply labour at a fixed price, and materials at cost price. But in reality he charged 50% more than the cost price for the materials. In other words, he deliberately lied to the customer in order to get her business. Now I can understand someone making a decent profit. My kitchen suppliers have done so, and good luck to them. But IMO business has to be conducted in an honest and fair manner. Had he told the truth, then he would not have got the business, and the customer would have realised it was a very poor deal. The fact that he said he was supplying the kitchen at cost price made it sound like a really good deal, given the modest fitting charge. The OP probably did not look round because a) it was a good price and b) there was a guarantee in the form of an invoice that the builder was telling the truth. Except the invoice was misleading. (I hesitate to say fake as that would imply that Howdens were complicit in fraud, and I have seen no proof to that effect.)

You expect business to be conducted in an honest and fair manner?!? What's wrong with you?! :D
