    Maybe a judge knows more about contract law than me , however your case is doomed to failure as the implications for you winning would change the face of trade in England as Scotland has its own Law system. It would put about 1 million traders in all industries out of business. Maybe you are moraly right but you are legaly wrong.Courts always favour the big boys in these cases, i should know as i have won 3 cases similar to yours that were put against me , you wont get your £2k back.
    If you win your case it will make front page news on every newspaper in the UK and get aired on TV.
    But i do admire you for sticking to your principles good luck !

    Hi Robert2011 - the case has already been heard and the judge ruled in my favour.
  • Why did it not make the media ? have you recieved your £2k yet ? In my cases the small claims court who rules over this type of issue found i had no case to answer, as i did not sign a contract document stating i would supply the materials at my cost price.
    Nor did i say otherwise to my clients in any verbal form , i am in disbelief you were found legaly entitled to compensation, i will check in the building industry media to read your case.

    C'mon Robert, you can't expect any facts of a settled court case in this thread, the op is now going in for a completely seperate criminal case so the can't give any details of the previous case! obviously the press can't get any details of this major test case either ;)

    An interesting post. Are you prepared to give details of your 3 similar cases? I for one am interested to know more, out of curiosity.

    This thread is hilarious now, do we honestly believe jillytb is telling the truth ?

    The simple facts are you had a 16k kitchen for 6k (trade price) and because the fitter had a trade account he got some more discount, which is none of your buisness, and is doesn't affect your quote.

    Sorry but I don't believe a word of your 'story'

    There are no details to give ,no paperwork nothing ! the arbitrators said i had no case to answer 3 times. If the pursuer has no contract stating the builder signed the contract document offering material at the builders cost , then the persuer has no claim for loss.Its not a criminal case its a civil tort.
    I think this case is fiction , made up, defeat is hard for some to take on the chin.

    But what happened? Are you saying you made a promise to supply items at cost price, but did not do so, and got away with it because there was no written agreement? Or did the client falsely claim that you said you would supply items at cost price as part of a larger deal?
