See post 31 where the OP refers to a "a civil court".

    OK thanks.

So that would be the County Court then (including small claims).

Bizarre that the OP won't furnish us with details. As it is now (supposedly) in the public domain, we could get details of the Courts decision ourselves as the_r_sole suggests.

All seems a bit fishy to me

if the case has been heard can we have the name of the court it was heard in and the judge making the ruling? then i can find the info and take the fishy smell off the posts ;)

(i am genuinely interested in what this judgement says - might manage to take a few folk to court soon!)

    That would be most welcome.

Lief, it is clear that you have grasped exactly what is going on and I appreciate that you are understanding of my situation.

I have been advised not to post any of the details on here in the public domain at this stage.

you don't have to post any details of the current case on here at all, everyone is interested in the original (county court) case, which there is no reason not to give details of.

As I said before I have been advised not to, for now.

who has advised you not to make the details known to an internet forum? you could tell us the date/location and judge on the original case and we can find the ruling - that wouldn't be providing specifics at all :)

I took the builder to court over this matter and others, the judge agreed that I was misled by the builder and that he did not pass on the discount, he also did not allow the Howdens Manager that the builder brought in to the court as a witness.

I have all the court notes and I would say to anyone out there both consumers and builders be very careful how you word things and remember that the invoices are the guarantee as far as Howden are concerned and people like me are not so naive and will follow this through.

I have now been advised that as it was proved in a civil court I can now go to the police which I am doing.

Thank you to all who were kind enough to post supportive comments and I am so pleased with my victory. If you find yourself on the receiving end of a builder who is trying to cream off more profit to themselves when supply goods contact me. I had the same with an electrician recently and they ended up supplying all material at cost!!!!!!!!!!!

If you were advised not to give details of what has happened why did you make the above post?
