Quite agree wonder what has happened to the personal data. As far as I was aware all the information was held on a database. At the moment the Solicitors have no access to this until Severn administrators consider what to do. Really hope this gets sorted out for everyone.0

Can I come in here? I was involved with the Loancheck project as many of you know, although I never actually worked for that company.
For any individuals out there who went through the Loancheck process please contact the solicitor in question and find out the position that your particular case is currently.
The Conditional Fee Agreement is between the solicitor and the client. Loancheck merely put the scheme and the panel of solicitors together.I am a former Broker, former IFA and former compliance officer, for my sins.

That is what has been explained to me. My solicitors have all the paperwork and data and are waiting to get permission to carry on with the cfa.:mad:0 -

Most are contacting solicitors and the solicitors are not responding. There are some wanting to pull out after waiting 2 years and getting no where and the solicitor is stating there is a hefty fee if they do. They have now missed their opportunities of using the FOS also as FOS are taking complaints against insurers from what some on here are told.
How can they get their data back now. Loancheck handled that data and also the introducers handled the data and the solicitors, who has their data now and should ALL companies be on the data protection register to handle data.
Surely you can understand why people are worried after all that we have said about lenders not complying with this and that.
I realise the data is passed on but ANYONE handling it should be registered.0 -

The issue lies with the solicitors. I have sympathy for those who have waited and not got anywhere, so far. I am one of them. I too signed CFAs with Loancheck lawyers.I am a former Broker, former IFA and former compliance officer, for my sins.

Indeed, Peter B worked alongside John Whittaker in Loancheck's previous incarnation, which also went bust.
However, as has been already stated, any clients retained by solicitors have no data issues (Law Society Regulated).
Any clients of Severn Administration in administration have no worries (administrators are regulated).
It is more than likely that the cases will be transferred to organisation(s) that will at least progress the claims (who will be regulated and/or registered under Data Protection).
Any organisations passing work to solicitors either directly or indirectly are and should have been regulated by the Ministry of Justice.

Just to clarify, The company I worked with was the main introducer to the Loancheck Service. I was not an employee of Loancheck, more an associate.
I was reminded many times that I was not part of Loancheck while working "along side" them.
What is more important here is that valid cases are run to conclusion rather than discussing whether data is protected. All solicitors will have data protection.I am a former Broker, former IFA and former compliance officer, for my sins.

Yes I know what it is like. My cases have been waiting for a long time and I am still waiting.
As for my involvement, our company introduced cases as a service provider (the term used in our service agreement).I am a former Broker, former IFA and former compliance officer, for my sins.
