loancheck/solicitors claiming ppi

    Hi Lesley you may well find that if you are already allocated a solicitor that they may take the case on. I think they have to check with Severn Administration first to see if they allocate to a different solicitor or give the Solicitor permission to carry on. If a barrister was being involved then surely it would have been risk assessed and gone onto the next stage. If they have appointed a barrister this would have extra cost to it and they would not do that unless they were hopeful.

    hi all

    would just like to say thankyou for all your advice and help.

    just to answer a couple of your questions, yes it was Peter that helped me onto the next stage of this once i had seemed to hit a brick wall trying to reclaim on my own, i have sent him a pm him asking if he could give me any advice but as yet have still not heard back.

    i have e mailed the solicitor every day since last thursday and surprise surprise have not had a reply, i telephoned his office today and apparently he had just popped out, his secretary took my number which to be fair she should know off by heart by now and she said that he would call me back but as you've probably already gathered this didn't happen.
    the last correspondance i had from him was 12th january letting me know what his charges were mounting up to and each one averages out at roughly £6000, i have 5 currently with him at the moment. i checked the terms and connditions that i signed again and they state that he would keep me informed every 28 days by either phone call, e mail or letter, if i was to terminate the agreement then i would be liable for the costs incurred so far.

    i will endeavour to try loanchecks new number and address tomorrow to see if i can get any joy withh them but to be fair i don't really hold out much hope.

    i started this whole process nearly 2 years ago now and i dont think i will actually now get anything back but what i really don't want to happen is now being landed with a bill for £30,000 for works that the solicitor has already said that he has carried out.

    will keep you posted on how i get on with loanchecks new number.

    Were you told that you would not have ANY charges on this claim and what did you sign? Whenever Peter has been on here he has always said that "this service" was free. I cannot believe what this solicitor has told you now. Are you sure he has said these charges are "yours" and not what he is claiming back for you?

    I would certainly get some advice on this one lesley. If you have signed this and currently are "owing" this amount then they must have done some work for you. What were the terms on which you signed to have these agreements looked into? Did they mention "charges" at all. I was led to believe that all charges were levied to the lender from posts on here. He always used to say this was a totally free service and the only (or another one maybe) free service of this kind.

    sorry i don't think i explained myself very well, my heads all over the place, this is a no win no fee agreement but on the conditional fee agreement that i signed it states that if i end the agreement before a win or a loss then i would be liable for the charges and disbursements to date.
    this is why i feel i can't tell him to call it a day and ask for all of my documentaion back even if i could get hold of him.

    There must be some time limit though Lesley on these things and also you should surely have updates from them and you say that January was the last time you heard. I cannot believe that you have waited all this time and still not got anywhere with it. Did they give you any time limit on this when you signed? Maybe you are nearing winning with the complaint??

    Seems to me that two years is a long time for any complaint and also perhaps take a look here if you have any discrepancies with the solicitor and how he is dealing with it.

    when loancheck sent their representative out he said that most cases were done and dusted within 9 months, i too cannot believe that i have waited this long, i suppose i had just given up and thought i wouldn't get anyhting back and i still dobelieve that but i'm just angry now that he won't respond to me and i'm fritt to death that i'm going to get a huge bill through the door.

    Take a look through the link I put on my post before and see if anything applies. I too would be scared of a huge bill and also the fact that they can hold this over you for so long and it could be another few years and there is nothing you can do:confused:. I would look at the terms being unfair in the agreement perhaps between yourself and the solicitor in that they have failed to keep you informed. Where did you give your data etc to. Was it Loancheck or just the solicitor? Who has all your documents now? You really need to MAKE the solicitor get in touch somehow..

    Maybe they are just finalising things for you and there is no charge at all???

    Let us know the outcome on this one lesley. If you need any help on reclaiming from here just ask away. I know that there have been some that have taken their complaints about unregulated brokers etc back to FOS and they are now pursuing the insurer/underwriter.
