If you call them tomorrow they with lodge a complaint for you and send you paperwork.
Have drafted a letter to send, with the letter I have from Barclaycrap confirming their error, to Worst Cretins first, giving one last oportunity to send an appology and confirmation that I won't be bothered by them anymore. Have given them seven days (from postmark) to reply, as they chose to ignore my last request.
Am also going to phone Barclaycard when am able, and ask why the hell Worst Cretins still have this account, since it relates to someone else and was a failure on the part of their tracing service.
If they Worst Cretins chose to ignore the second letter I've had to send pertainig to this, I definitely won't hesitate Financial Ombudsman, and have said as much in my letter to Worst Cretins.
Now, what to say in the leter......0 -
Well, letter drafted - will probably send today, but any opinions on whether it sounds okay would be appreciated:
Formal Complaint
I write with reference to your letters dated 29/10/09, 09/12/09, and unfortunately a letter dated 01/06/2010.
Please find attached the letter that I received from Barclaycard on 08/12/2009 confirming that an error was made on their part and that the account/balance is NOT owed.
This matter was resolved directly with your client, and this is the second occasion on which I have had to send a letter of this nature, (please see attached letter dated 15/12/2009, which was sent recorded delivery). As you chose to ignore said letter, I will repeat that I expect an apology, confirmation that you have closed your files reference this matter, I will receive no further communication from yourselves, my details will be removed from your files and my credit score amended accordingly.
I expect a response within fourteen days from the date of this letter’s postmark. Should this not be forthcoming I will not hesitate to refer this matter to the Office of Fair Trading, The Financial Services Ombudsman and DWT Solicitors (Kidderminster), to commence action against you for breach of OFT guidelines (section 2.4f) and the distress that you have caused.
I look forward to your response

This is awful Reggie, not a lot I can add to other people's responses but I personally would be making the formal complaint and chasing them for compensation for their waste of your time and the distress you've been caused by them. It's disgraceful.0

Thanks for your input - have added the fact that I wish the letter to be treated as formal complain to the letter heading; something I had neglected to do!
Am sick and tired of 1st Credit - if they won't accept a copy of a letter from their client as evidence that a mistake was made and the debt isn't owed by me, how on earth are you supposed to make them get the message?!

Dont need to claim any Compo yet. They must reply to you within a reasonable time ( two weeks is more than reasonable ). They must state that their reply is their Final Response....whether they feel that the matter is resolved to your satisfaction or not is irrelevant at this stage.
Within 8 weeks of their Final Response, but not more than 6 months after, you can then make an Official Complaint to the Financial Ombudsmans Service.
Their (simple ) Form will contain an answer box into which you can enter what you feel would be suitable to make good for your inconvenience, distress, damage to credit file etc ( you dont have to give a financial amount, the FOS will have an idea).
If they write with just an apology, dont accept this, insist that they cvonfirm that this is their Final Response...those two words are important to you and they CANNOT avoid using them!
Dont let them get away with just an apology! By the way, their Head of Compliance is Robert ( Bob ) Kingdon, their MD is M Cleary. Write to Bobby Boy though.
Good Luck and let us know how much you get out of them, maybe that will encourage more people to take simple, but punitive, actions against scum like 1st Credit and their other scavenging cousins.;):D stay wonky

Since I hold NO faith in Worst Credit whatsoever, and expect that they'll ignore my letter again, any advice on what I should write to the FOS?0 -
Forgot to update this - I DID receive a letter from Worst Credit, apologising for the error. And the words 'Final response' were used too.
And this was a few months ago -I am therefore offically debt-free!!0
