  • Well, finally received a letter from Worst Credit confirming that the account is disputed. Wish they'd all get on with it though!

    Nope - the only other credit card I had was a Crapital One card, which was applied for several years after I defaulted on my old Barclaycard. And the Crapital One account was paid in full earlier this year.
  • Well, still waiting for contact from them regarding this.

    Quite annoyed really - have technically reached the point where I am, finally, debt free, but can't really consider myself debt free whilst this matter is ongoing!

    Great - just received a letter from Worst Credit's solicitors containing the usual threats and warnings, despite the account being in dispute.

    Is there a template letter I can use, as the account is still in dispute and I'd heard nothing from them following their letter aknowledging that the account is in dispute.

    Don't take kindly to receiving more threats considering that the dispute was never resolved!

    Have they sent you a letter acknowledging their Complaint and enclosed the Information Leaflet about the Financial Ombudsmans Scheme? They should have by now as that is a Legal Requirement.

    Have yuo sent them a Default under the Consumer Credit Act? There is a template for that.

    You can also write to them and tell them that their continuing actions are causing you considerable stress and inconvenience and you consider it appropriate that you are compensated for this ..

    Although to be honest I am more interested in knowing A: what the heck this aledged debt is for, as per eariler posts in this thread and B: why Worst Credit wrote confirming the account is in dispute only to pass it to their solicitors without resolving the dispute.
  • Well, have used one of the template letters found on these boards and adapted it for my needs - is it usable?


    ACCOUNT IN DISPUTE

    Dear Sir/Madam,

    Your ref:


    Thank you for your letter of
    26th November 2009, the contents of which are noted.

    I must admit that I am rather bemused as to why this account has been passed to yourselves, as it is in dispute with 1st Credit/Barclaycard and has been since
    29th October 2009 as per the attached letters.

    I have heard nothing subsequent to receiving the attached correspondence and therefore no further action or payment shall be made until this matter is resolved. You will also be aware of the CPUTR 2008 and the OFT's guidelines on debt collection which state under the title Deceptive and/or unfair methods - Examples of unfair practices are as follows – 2.8


    (i) - 'Failing to investigate and/or provide details as appropriate, when a debt is queried or disputed, possibly resulting in debtors being wrongly pursued'

    (k) - 'Not ceasing collection activity whilst investigating a reasonable queried or disputed debt'.


    Consequentially any legal action you pursue will be averred as both unlawful and vexatious. I reserve the right to report your actions to any such regulatory authorities as I see fit.

    I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you would prefer to do this than simply respond with standard letters and leaflets.

    I look forward to hearing from you in writing.

    Can't really help Reggie - but I do hope you get a decent response soon (the letter seems fine to me btw - just I have no personal experience!)
