    Sounds a nitemare thourght barclaycard used westcot services.

    Just a thourght.

    The original lender ie barclaycard sells debt to another company

    surly they keep records of who they sold it to?

    So they either passed it on to hfo or worst credit acn they not confirm who and the amount?
    They cannot sell the same debt to 2 different companies.

    Also cant they look back at their records confirm you only had one barclaycard and balance?

    Sounds like mistake and they using nasty tactics to get money.

    Hope you get it sorted.

  • Worst Credit really are useless - haven't had a reply subsequent to sending the letter.

    Doubt they'll admit that the solicitor letter shouldn't have been sent!

    Hmm I'm guessing they are in the wrong (totally!) and you should be demanding £50 damages for stress caused :D

  • Received letter from Barclaycard this morning, admitting to a fault on their part and confirming that I DON'T owe them a penny.

    Therefore......... I am offically DEBT FREE!!

  • Just read your saga as I received a letter from Worst Credit in the post this morning (not for me, for the 'Occupier' and needed some advice).

    Am really pleased - was certain that it was a error on their part from the onset, and was extremely releived to receive the letter confirming it today!

    Will be writing to them anyway - was NOT impressed at receiving a solicitors letter whilst the account was in dispute, and want written confirmation that I'll never hear from them again and that my details will be removed from their files! They are a plague!
  • All things considered, I have decided to send the following letter to them but could use opinions on whether it could use any amendments:

    To Whom It May Concern:

    I write with reference to your letters dated xxxx, xxxx and a letter received from LCS Solicitors/1st Credit legal department, acting on your behalf, on xxxx

    Please find attached the letter that I received from Barclaycard on xxxx confirming that an error was made on their part and that the account/balance is NOT owed.

    As your client have now resolved this matter directly with myself I require confirmation that you have closed your files reference this matter, I will receive no further communication from either yourselves nor LCS solicitors, my details will be removed from your files and my credit score amended accordingly . I will also add that, if said actions are not taken, I reserve the right to report to the OFT, as the account was referred to your solicitors whilst it was still in dispute.

    You will be aware of the OFT's guidelines on debt collection which state under the title Deceptive and/or unfair methods - Examples of unfair practices are as follows – 2.8:

    (i) - 'Failing to investigate and/or provide details as appropriate, when a debt is queried or disputed, possibly resulting in debtors being wrongly pursued'
    (k) - 'Not ceasing collection activity whilst investigating a reasonable queried or disputed debt'.

    As per my letter to LCS solicitors, I had hoped that you would enter into a sincere dialogue with me about this matter and wrote on the assumption that you would prefer to do this than simply respond with standard letters and leaflets. Unfortunately you did choose to respond with another copy of one of your standard letters and, since it was one that I had already previously received, I find this completely unsatisfactory and do not feel that my requests are unreasonable in view of the distress that you have caused.

    I look forward to receiving your response.

    I would also add,

    This whole matter and your manner and frequency of communication has caused me considerable distress.

    It is clear that both yourselves and your Clients have made a serious error and I will expect a full apology from your Managing Director, Mr M Cleary, along with your proposals to compensate me for the distress and inconvenience caused.

    I will expect your reply, by post, within fourteen working days of this letters postmark. After that date I reserve my right to report you to the Office of Fair Trading, The Financial Services Ombudsman, The Credit Services Association and your local Trading Standards Office. I also reserve my right to report you to the Police as your representation to me were made fraudulently.....next time, check!
