Wow, bargepole! I shall write to Sainsbugs about their daft leaflet with the same 'incorrect word' this weekend.

Will let you all know if I get a reply, in due course.

I went back to Sainsbury's High Wycombe to see the results of my complaint:

So the word "fine" is now replaced with "penalty". I think I'll wait until they've paid out to get the signs redone permanently, before writing again to point out that they can't enforce penalties.

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

  • I can't see them putting ""a £50.00 unenforcible invoice"" Does'nt sound very threatening does it?
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

I would surmise that the alteration to the sign was performed by the Private Parking Company.

I must congratulate bargepole, if more people were this pro-active it would be terrific.

Well I sent my letter snail-mail to Sainsburys' HO today. I objected to the word 'fine' and suggested that they may like to withdraw the leaflet completely.

I also said I believe that introducing a restriction of their disabled bays to 'Blue Badge holders only' (also emblazoned on the dreadful leaflet) seems to me to fall outside of the DDA obligations which are statutory for any retailer which provides car parking spaces.

The DDA definition of a disabled person is very clear (and it doesn't include 'having a Blue Badge'). AFAIK, disabled bays provided by retailers must be available to anyone who meets the DDA definition of disability. If not, then they are treating some disabled people differently (people who rarely travel by car, or foreign visitors, may fit the DDA decription but wouldn't be expected to have a BB).

I also pointed out that BB's have no legal status on private land anyway, in case they or their PPC's have overlooked that fact.

I will update here with any response I may get.

That "fine" leaflet is still around. I found a pile of them in a Sainsbury's cafe in Lincoln today.
    Here is the leaflet:-

    Picture 1

    Picture 2

To make things worse, in the store there were two reps from a power company chasing people up and down the aisles trying to get them to switch energy providers. So two black marks Sainsbury's!
What part of "A whop bop-a-lu a whop bam boo" don't you understand?

The second leaflet says only park in disabled spaces if you have a valid blue badge.

Doesn't say anything about having to display it.:D
