    Okay I'll deffo go back then, Probably be on Monday.

    I don't mind if THEY send it off to be repaired but I'm not paying for it to be. There is some nicks and scratches on the DS but that's just regular wear and tear, and DD plays with (which I wouldn't say) because he was going on about how he has got people in before about the hinge but they let their kids play with them and if you look in the booklet, it says it shouldnt be for kids aged under X years. YEAH OK SO WHY DO THE GAMES SAY 3+.

    He was really nice about it, Guess that's why I believed him? !!!!. I'll kill him on Monday. Glad to know that legally they have to fix it, so I'll just go in screaming about not fit for purpose, sale of goods act and trading standards? Oui?

    I actually just phoned consumer direct, and the guy told me that If I want I can go back in to the shop and do face to face negotiations, if that gets me nowhere, then to send them a letter recorded delivery, and If I don't hear back within 14days, to phone them back up and they'll get onto trading standards.

    So I'll try the shop one more time on Monday, I'll quote all the gubbins I need too, electricals are supposed to last more than 8 months, less than satisfactory quality blah blah, and if that doesn't work then I'll just say fine, you'll be hearing from trading standards then, then saunter out.

    Can you print out info from online showing that it is a common fault? If you take it in with you then it shows that it's more likely a fault rather than misuse and also shows that you mean business. In my experience what they do is dependent on how far they think you will take it and how well you know your rights rather than whether they legally should or not. (i.e. if you show that you are going to jolly well persue them till they do what you want and you know your rights they're more likely to give in.)

    Ta, I'll do it publically cos it's about money and parenthood so may be useful to any lurkers :)

    But feel free to skip!

    before Fergus came I had a part-time job (that I'm on mat leave from) on a 0.5 contract and also used to do some self-employed work. One of these arrangements was working 1-2 days a week delivering counselling sessions, for an organisation. I would then invoice them for sessions done and they'd pay me and each year I'd tell the tax man all about it.

    Simples :)

    as a self-employed external contractor I've therefore had no sick pay, holiday pay or maternity leave or pay, no problem, as I had it from my part time salaried job.

    I knew they wanted me back after Fergus, and I was happy with that and we'd loosely negotiated a day a week by email. I was due to start on the 8th. I haven't yet told them about the PG cos it wasn't the second tri and they only want me up til 4 weeks before I'm due, which is the timing I did for them last year and all was fine from both sides :)

    I've just had an email saying that the organisation have been having negotiations with their HR dept, who are pretty unhappy with the arrangement with the external counsellors like me.

    From the email: 'HR have now said we can employ you but you have worker status with holiday pay entitlement.
    So we will be changing the way you get paid probably will be time sheets as opposed to invoices.
    Also the hourly rate may have to change but we can now pay you for note time, research, meeting and supervision time to keep the rate up
    (name of bigger boss) is trying to pin HR down so we can give you all a start date - doesnt look like it will be Oct 8th now but any lost time we can add on to the end'

    Does this mean I'd be eligable for mat pay and benefits by them too?


    Is it therefore unethical/unfair for me not to immediately mention the pregnancy (I kinda prefer to wait til after anomaly scan...) since they may be making themselves liable for a financial outlay they don't know about.


    Also all seems a bit complex with having 2 employers etc.


    Just wondered what your thoughts are about all that (if you're still with me!:o)
