Tucan claims were very quick to remove £249.99 from my retired mums bank account, (she is 82 years old on medication) and had no real idea what they were trying to sell to her and she made the mistake of giving her card details to this company and trusting their staff had her interests at heart.
The reaction from the staff when asked to return that money was some of the worst experience by myself with any company ever. Under the cooling off period - should you decide that you have changed your mind and notify them of your intention to request a refund. You can be sure they will attempt to string you out for 30 days (which they also claim does not include bank holidays or weekends..only working days) One of their telephone operators who seemed to think he knew more about the law than any solicitor would.
I had to get in touch with trading standards about them as they do not seem to want to comply with their obligations under the law. This states that a refund must occur within 30 days and is inclusive of weekends and bank holidays.
I am writing this as I feel there could be other old or vunerable people out there being targeted by very convincing call operators who say that you have nothing to lose and you will get all your monies returned to you within 14 days. You will have to fight to get any return once they have your cash and turn from being nice sales to tricky return artists.

Your absolutely right. Tucan claims also tells you that if they do not make a successfull claim then your money will still be refunded in full,but this is still not the case,they are totally out there to rip innocent people off ,it is beyond belief that these people stoop so low as to target the elderly in the way that they do,they really need to be stopped completely or more and more people are going to get hurt.I wish you all the luck in the world as innocent people like yourselves do not deserve such treatment.It seems the only way is gonna be watchdog,perhaps then it will cease. :mad:0

I just had a call from them and threw them into a tailspin. When they said my credit card limit had been raised without my consent I said "really! tell me how do you know that and who is my credit card provider?" The reply was Visa (it isn't Visa !). So I said "Yes O.K. but who actually issued it?" There was a long silence before I said "I do not give any company permission to give my details to a third party. If you have my details then you and the company who provided them are in breach of the Data Protection Act. This number is registered with the Telephone Preference Service so you should not be calling me anyway. Where are you calling from?" The answer was "Bristol". My final reply was "judging from your accent and that of your colleague you are actually calling me from the Indian sub continent so I think you are lying to me, this call is now terminated." At that I hung up. Somehow I don't think I'll hear from them again !!0

I just had a call from them too. I listened to what they said about reclaiming on bank cards as I have a couple in default, it did make sense that if the bank put your limit up without asking you to sign for it they would be at fault if you fell into default. So why should you have to pay if they have no paperwork. (before you jump down my throat and tell me to pay my cards and not to spend if I can't afford it) I was on benefits when I received credit cards so really the banks should take some responsibility when giving out large amounts of money on credit cards to people who are struggling to make ends meet.
Anyhow I dont have £2.50 never mind £250 to give to them so they are sending me a pack. They said they can go back 15 years to claim back. I might actually try and do it myself, send in the £1 and ask for my credit agreement and see where we go from there, the Aqua card limit was about £2000 it is now £4500 with charges so I have nothing to lose by trying. Another reason why they give so much out, they get it back double in fees.0 -
Beverley - You won't under any circumstances find your cards are legally uneneforcable because the credit limit was put up. Absolutely no chance.
Thats not to say that it isn't possible that your agreements might be unenforceable for other reasons, they could be, but it won't be to do with the credit limit.

Of course it wouldn't be the banks fault. If you had kept your spending to the original limit and not spent anymore then you would be in no way more likely to fall into default that if the limit was kept the same. If anything arguably it should be easier not to default on an agreement with a larger limit.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
I am new to this site and would really like some help if there is any one out there who can. I have just recieved a telephone call from a company called "toucan claims" who claim to be able to wipe all of my credit card debts and interest paid if the card companies have ever increased my limit or do not have a hard copy of the original credit agreement. I am currently experiencing money problems so obviuosly this sounds fantastic, however they are asking for a £250 upfront payment for registering the claim. Is this to good to be true as it sounds and if i go ahead am i going to have lost £250 that i dont have and still have all my card debts. Has any one any experience of this.

Hi there, do NOT use Tucan claims.
They are registered with the Justice dept, promise the world, I put in a claim over two years ago and the reason I am writing here is because your comment flagged in the search engine.
They will not give you a progress report, they will not send you and information, they will not give you any money.. I was in debt in May 2009, I paid their fee, I tried to contact them repeatedly, took names, asked for call-backs, got absolutely nothing over two years.
I will be requesting my money back immediately, these people are telling you they can get you back thousands but have no idea if they can? In my opinion, its all about the initial £250.00.. 10 or 20 of those a day is not bad money for a few phone calls..
After I send this, I will be writing a stern email to them, and the Justice department.
