  • I think the bottom line here is that if a company is asking for money up front then don't deal with them. Most decent companies will take their fee as a percentage of the compensation they win for you. Be sure to check what percentage they are charging first though. As I see it asking for money up front means that they either a) don't want to risk you not being successful in your claim or b) they aren't on a firm financial footing themselves and need cash coming in.

    #92 - no the bottom line is don't use any company. Still won't get their debts written off whichever company they use.
    What a company can do an individual can do for themselves very simply and without paying fees before during or after.

  • Tixy, I'm not talking about people trying to clear their debts, that's a different matter altogether. I mean only people who have a genuine case for having been misled or mis-sold a product. I can't see that anyone can get compensation because their credit limit has been increased by the credit card issuer, that's fairly common. It's their responsibility to contact their issuer and tell them they don't want an increased limit. If they go ahead and use that new limit then that's their problem. All you have to do is look at your statement each month to check you're card's limit so ignorance of an increase is no excuse either. Again I say that a reputable company does not ask for money up front, whatever field of commerce or industry they are in. A deposit to show good faith maybe but not whole amount payable.

    With tucan claims it doesnt really matter if its a genuine claim or not, do not use them as they will take your money and get you absolutely nothing.Beverley126 says tucan told her they could go back 15 years it seems they tell a lot of people that but the bottom line is when you manage to get back to them months later after they havnt botherted to get back to you after pocketing your £250 they will change the story and tell you it can only be taken back 6 years,if you go with this company you can guarranty being a further £250 in debt.They may be registered with the ministry of justice but that means nothing .They will promise you a refund if they are not successfull with your claim but you will not receive one, it seems the only training these guys get is in how to rip off the innocent.I cannot believe that with all the people that have been on forums about this scam company that they are still able to rip people off in this way,watchdog definately needs to step in to prevent others from getting hurt.

    But those people still don't need to use a company to help them - upfront fees or success fees. Far better to deal with the case themselves, put in their own reclaim with the creditor direct and if necessary taking it to the FOS. Plenty of info on this forum and others so that people can do this themselves without prior knowledge needed.

  • i to was contacted today but from a place called the Claims consortium trying to tell me that for £594 they could wipe the debt of my credit card, and this had to be paid up front, something about under the consumer credit card act of 2007, the government changed the law and when it changed, no new credit card contracts were sent out to be resigned, this putting them in breach of contracts, sounds to me like a scam, but what im trying to see is if there is any truth to it in general, with all the current claims going on and lets face it the banks to make there money etc have scamed us before etc.

    Very little truth in the way it has been put to you by the dodgy claims company.

    The reality is that some creditors for some old credit accounts didn't have consumer credit agreements that contained all the prescribed terms under the consumer credit act. In these instances your account could be uneneforceable. The debts are not written off and the creditors can continue to report to the credit reference agencies and continue to chase you for payment. If you stop paying the debt they can enter a default on your credit file and basically wreck your credit file for the next 6years.
    What they cannot do if the debt is unenforceable is take you to court.

    But there have been a number of legal cases on this subject and creditors can usually produce a reconsituted version of your agreement even if they cannot find the signed credit agreement from when you originally opened the account.

    But even if you want to conisder this route, accepting that your credit file will be wrecked, there is still no need to pay someone to do it for you. You can do it yourself for a few quid.

    Just had a call today from Toucan, saying much the same, my visa card limit has been increased without my permission and they can claim compensation for me. I have two cards, both visa so asked which one?, they didnt have an answer, so I asked where they got my name and number and how they knew about the increase.. OH??? had to put me through to someone else. I spoke to the senior litigation manager ( yeah right ) he couldnt answer the questions either.... So it seems they are still trying this scam. I just hung up but the last number redial came back as 0845 0044237. ring it back and you get a recorded message saying you can have all your debts written off and be debt free... and, apparently, they ( the message didnt say who "they" are) are authorised by the MINISTER OF JUSTICE???? always thought this type of company were governed by the Financial Services Authourity.. who I shall be calling next along with trading standards. Be serious people, if you part with your personal financial details, to a voice over the phone, who just SAYS they are someone, well, you would have no one to blame but yourselves. PS checked with the FSA and apparently Debt Management and Debt Consolidation Companies ARE registered by the Min of Justice !!! we live and learn, so, they may be legit but its still a Cold call trying to find new customers.... Waiting for a call back to see if Toucan are registered
  • Toucan still at it and not sounding very professional with background call centre chatter going on. Wouldn't take NO for an answer especially as I didn't fulfil their criteria so had to ring off!
