There are many claims management companies operating which 'guarantee' to get debts written off for a fee. These companies are claiming that some lenders have drawn up their credit agreements incorrectly or due to the age of a particular debt the lender no longer has a copy of an agreement. Under the Consumer Credit Act 1974 if a regulated agreement is drawn up incorrectly or even non-existent then the debt could be 'legally unenforceable', however ultimately only a district judge at a county court can determine this.
If a debt is deemed to be legally unenforceable this will not necessarily remove it from your credit reference file as your credit file is a factual history of lending and not the debt's legal position.
The Ministry of Justice is the regulator for claims management companies and you should first check to see if the company is authorised. Your local Trading Standards office can also check your agreement for you free of charge.
Myself I think it is not right to get out of a loan you have signed up for if the "I's" are not dotted or "T's" not crossed. If you are in debt crisis then you should seek FREE debt help.

I used them ref ppi and credit cards- they did half a job took them for ever and didn't get me anything and to top that, they are refusing to refund my upfront fee of £250.00
I intend to complain to moj and every consumer TV show i can think of, also might try small claims court? anybody got more ideas.

Tucan claims rang him out of the blue yesterday, telling him that his mortgage provider, the Woolwich had withheld equity from him for some reason when he went for an endowment mortgage years ago. They said if he gave them £250 up front they could award him £2,500 compensation, with 10% off for legal costs. Thanks to you, I found out how bad they were, and told my friend, who still gave them the benefit of the doubt (he's too trusting for his own good). They sent him some literature and he read it, saying that it was well presented and very believable, as the rep had been on the phone.
But today, he took another call by them and they told him that they had talked to his wife and she was in agreement to go ahead with the contract, and that he should give them his credit card details now to set it into motion! This was a blatant lie, as his wife had not given them the go ahead, and so they were trying to get his bank details from him under false pretenses. Fortunately, he told them he was not interested.
Later on today he was called again by a guy from Tucan, pestering him to rethink his decision again, promising to get him £2,500 - all the banter. When my friend said that he would like a few weeks to think it over just to get rid of him, it worked - the guy said, 'that's too long', and hung up! As if that would make him want to do business with him! :-z0 -
hi i did go with this company because i was missold ppi and they have cleared off my card because it had been increased also i recieved just over 1300 back from the ppi so it really does work and from my own claim its not a scam0

why would you think they're real? if you're in financial difficulties, contact your lender and seek help.0 -
Welcome all the staff members at toucan, way too many 1st time posters on a thread.
You can get your debts written off for free. Just sar you credit card company or loan company enclose £1 and if they can't supply you with a valid CCA then they can't claim the debt. There you go saved you £250I all have learnt is from others on many sites.
Seek legal help if unsure.
Dont pay Private Parking tickets - they are mere invoices.

Lol you paid for in effect is one phone call to get your ppi. Sorry again another 1st time poster loving them, shame they took your money when I could have told you the info for freeI all have learnt is from others on many sites.

you've got no hope at all of seeing that money again.
i guess just see it as a costly learning experience, that will teach you that throwing money out of wriggling out of paying off your debts is a stupid, thoughtless thing to do.0 -
Thanks For all the advice.I got a call yesterday from Tucan .Basic story is that I could claim just because my credit card company raised my credit allowance without me signing a new contract. As I have not used the full amount and always pay off the balance in full I thought this very strange. I told them I would never pay a fee without first checking the company out. When they call back I will tell them to go away.0
