    Well Anon,

My query will be,I have not been charged at all for wap/gprs usage over the last..say 6 years, using the same telephone number firstly on payg then changing to contract and porting the number to contract.

They surely can not suddenly decide to charge me,thus changing the t&c's on the contract, and claim that they have sent me a text explaning this,I definately didn't get it,but even if I had its still a change I didnt agree to
  • Check terms and conditions on your contract - in what way do they have to inform you of changes to your terms and conditions, written, text or poster display?

I still don't agree. I hold eight mobiles with O2 at work and have never been told anywhere that it is free. The rates for GPRS have always afaik been published on their website, and I have always expected to pay them should anybody need gprs.

My husband got a bill the same situation for £245 and his credit limit was £50!

When he phoned to complain the said that was just a guide, but I think it's totally pointless having it then but they soon wapped it up to £290.

My point was that I think the t&cs will refer to their tariff - their tariff has always (so far as I am aware) referred to GPRS/Wap being chargeable. Therefore they are not changing the contract, just implimenting it (what we signed up for in the first place). However, I agree that it would be interesting to find out if the fact that they have not been charging for it (particularly for 6 years or more in your case) has become an implied term of the contract and therefore by suddenly charging they are changing the terms.

It is also embarrassing that a mobile phone company cannot ensure that such an important text gets through to their customers (there seem to be a few of us here who never received it). As I point out above, there are many more formal ways they could let you know (even NTL, they who are often criticised, ensure that you get information with your bill).

Give them a call and explain that you really didn't expect such a high bill and that you can't afford to pay it and ask if you can pay by installments. I'm not sure if this will effect whether you are connected to the network or not but you could always give it a go.

After ringing 02 they are not prepared to do anything about the new charges they have made for GPRS

They said it is my contract that I have only 1MB of free GPRS per month although they agree that I have not been charged at all for wap previous to Apl 06 for years as apparently this was a promotion they were doing, allowing unlimited wap it would seem. A very long promotion period that was.

They stated they are free to end promotions whenever they choose no matter how long they have been running and it doesnt change the terms of my contract

Despite my insistance I did not receive any text message from them to inform me the wap promotion was ending (I wasn't even aware it was a promotion,I thought it came under my entitlement) they insist I definately did receive it.

Nothing would persuade them I didn't receive it,every single customer got the text they said, they wouldn't budge!

    02 customer service,useless as ever

I have an unlimited WAP contract but after unlocking my Samsung E 350 it lost the wap settings and they are no longer available on the O2 site.

Not sure if this will owrk but on the o2 ireland website you can still get the settings for the E350

Good luck and hope it works
