One of my biggest problems with ITC was that they INSISTED that the valuation given by me on my late father's property was the one they HAD to use by law as it was given at the "date of death". ITC stated that to use any valuation given at a later date would give rise to legal issues with the HMRC as the value of an estate for tax purposes is the "current value at date of death". They also stated that the only way to change a date of death valuation would be to apply to the District Valuer responsable for the area which covers the property. He will look at the approximate values of similar properties sold at about the time of death and work out a value based on those figures.

    So if they haven't contacted the District Valuer maybe this could be your way out of the contract? If they say they have, get the name and number of the valuer and call him/her yourself.

    As a footnote to this, ITC managed to add £50,000 to the value of my father's property by insisting on using my "date of death" valuation, and I'm guessing that prices are rising as we speak so by ITC now insisting on a more recent valuation on a property, it is likely to increase its value for ITC's "fixed-rate" percentage fee, isn't it?

  • I did get a reply back from the Law Society but as iTC are not a firm of solicitors they have no jurisdiction over them. They recommend complaining direct to the company which I have now done. According to the Information Commission Barclays can divulge a deceased person's private information because the dead are not protected by the Data Protection ACt. All very murky. I know iTC have applied for Probate but it has not been granted as it is early days. The feed back from everyone is greatly appreciated.

    Well that's very nice of you. I only wonder why or how you have been unaware of the appaling service that ITC have provided to so many people for so very long. ITC's CEO Martin Trees told me personally last September (2009) that HE would see to it that the problems that myself and many others were experiencing would be "sorted out as a matter of urgency". I guess that, given the speed that ITC work at normally, 5 months is not too long for the problems to have been noted by you!

    Yes, all too little too late. And so the appaling practices of ITC still go on TODAY in my experiance and so will the posts until ITC can behave and practice in a moral and professional manner.

    Why don't you simply spend a day or two in your probate offices and experience the lies, excuses and totally unprofessional way that ITC operate. Or just pick ANY case at random, contact the poor, brow-beaten customer and listen to their response. I guarantee that it will be exactly the same from whoever you pick!

    As a matter of interest, it was the "Customer Relations" department who phoned me with a satisfaction questionaire, AFTER my case was signed off. So you are clearly aware of the problems anyway!

    Well, well, well...Pigs really do fly!
    I can hardly believe it but I just had a call from the CEO of ITC Legal Services (maybe he's read this thread?), as a result of the customer satisfaction survey that they carry out at the end of every case. He was a very pleasent chap and appeared to be genuinely concerned about the way in which my case had been conducted by his company. He had full details of what had gone wrong and did not hand out wooly excuses for the mistakes. He had no excuse for the extreme duration of my case. The details of this conversation must now be kept private (though cached and sbsequently "quoted" MSE forum posts may have my original post on still and I have no control over that).
    The bottom line is that I am expecting over £1,800 off their charges to cover my losses and a goodwill gesture. (Though this really only makes the bill about what I originally expected).
    I told him that I had actively tried to put people off of using ITC and that I would now let them all know what the outcome has been, so here it is.
    Just seems a shame that no-one at ITC noticed there was a problem in the 17 months they were on the case.


    Customer Satisfaction Survey that they carry out on every case?? There is no such thing!
