I hope he doesnt pull the same trick my sister's ex landlord did.

Her ex landlord also didnt respond to the court, the courts been tight with cash do not use recorded or special delivery so no proof of receipt. About 2 months after she thought she won suddenly the case was reopened as the defendant simply said they recieved no correspondence and as such couldnt defend themselves, the court fell for it and now the case is ongoing. Seems to be a timewaster tactic.

Mmmm, this would not surprise me one little bit and it has crossed my mind as I know they didn't send our info by recorded delivery!! Hence why I will not rest until we have the money back in our pockets! This also applies to publishing the name of the venue and going to the press - I will just have to be patient and wait.
  • Your still waiting then :( thats a bit poo!

Received notification from the court yesterday that the defendant has not responded and they have received our form and therefore, we win the case by default. :j:D:j He has 28 days to pay us our £5058 or it gets more complicated (bailifs etc which we pay but claim back off him)!

However, he still has a few avenues to go down if he wants to squirm out of it so cannot start celebrating yet.:whistle:so I still have to keep quiet :lipsrseal. Just keeping fingers crossed but I have an awful feeling he will claim he didnt ever receive the letter from the court.

If he pays within a month he can also request that the info is removed from the Register of Judgements, Orders and Fines (this is what gets passed to credit reference agencies making it difficult for him to get loans etc) - I wasn't aware of this and think that is a real shame and obviously this is what he has done in the past (when I looked into the company, the times - four times I think - when he has not responded to court were not shown anywhere which I thought was a bit odd at the time but now I know why).

Will be checking the letter box every five minutes now just in case :) .... I just hope he does the sensible thing and doesn't string this out for longer.
