    Am I legally entitled to make a backup of my original software?

    The rules regarding back up copies apply to software; they do not apply to other copyrights such as film and sound recordings.
    Since computer games comprise of a number of such rights, the answer so far as computer games is concerned is that making a back up copy is not a permitted act under copyright law.

    So far as copyright in software is concerned the law provides that the lawful user may make a backup "where it is necessary for him to have for the purposes of his lawful use".
    This clause dates back to the time of the 16-bit machines when, because of the volatility of floppy discs and problems with software carried on tape cassettes, back up copies were thought necessary.
    Therefore, it is ELSPA’s view that it is no longer necessary for users to create backups of their software. This view is underlined in the judgment in the case relating to the illegal chipping of PSX consoles referred to below. *

    Pirate web sites with disclaimers stating "you are legally entitled to make one backup copy..." etc. misrepresent the legal position.
    In the words of Mr Justice Jacob in the above case "Back ups are not necessary at all".
    Moreover, offering commercially to provide back up copies for users, or discs with illicit games purportedly for the consumer to sample, are very likely to be infringing acts and may also lead to the commission of criminal offences carrying a penalty of up to 10 years imprisonment.

    Do you really think that any sane law abiding person would register for a forum account on a business site that is designed to support piracy?

    Yes I know you say it's for backups but you know as well as anyone else does that your only saying that in a vain attempt to cover yourself, You know full well as does anyone else that the vast majority, if not all customers that use your site, will not have the originals and are simply using your site to obtain pirated goods (if they don't own the originals, then they are in effect getting a pirate copy)

  • Click store. Nothing at all about 'backups' just adverts for Vista at £3.50 and somewhat ironically Nero 8 copying software for £3.50. The pictures used quite clearly show the manufacturers boxes so it's not just the software that is being pirated but the packaging as well.

    I'm just asking Ahead how they manage to sell it to dealers so cheaply.

    When I was in Saudi for Gulf War 1,a mate bought a load of 'back up' cassette tapes of his fave heavy metal bands from the Souk....When we got back to BFG,Half of them were......BLANK!!!:eek:

    Hmm 24 hours is nearly up, so I guess that the thread will be deleted anytime soon, well if XLT's statements are correct, but it's a little hard to sort truth from fiction when someone can't keep their word at not posting anymore.
