    1) Section 230 of the Communications Decency Act (USA), 1996....?This Act specifically states that "no provider or user of an interactive computer service shall be treated as the publisher or speaker." That legalese means that, unlike print and broadcast companies, online service providers cannot be sued for disseminating defamatory attacks on citizens posted by others.

    So you spent all weekend looking up irrelevant stuff?

    As a reader of this forum, I will remain neutral on the product they are selling and whether it is illegal or grey area. However, what I have found unsurprising is how unprofessional the replies have been from a company. Would you catch Sir Fred Goodwin being this unprofessional in spite of the egg on his face? nope.

    Anyway, XL Trading, if you are reading this, it is better to admit your mistakes rather than take on the wrath of this forum.

    1. Reported this thread to Google as it contains information about our business that should NOT be shown on a public forum.
    Don't bother deleting posts as it will already be cached by google and we also have screen grabs in any case.

    Why do we keep posting?
    Just because its run watching people aimlessly throw stones when we can throw rocks and eventually have this resolved to OUR satisfaction.

    EDIT; Users on here should be mindfull about what they type also - as we can easily ask Nominet for the contacts information and have a written report sent in validation on what 'salerio' has mentioned on here, which they are legally allowed to provide to us. We can ask Nominet IF any of the details in that statement made by Salerio were true and also keep a copy of the phone call OR get a written statement by them refuting such a post.

    Basically, the UK High Court has set the precedent that google is not liable for any material that it links to as it is not the author of said material.
    Google issued a statement after the ruling, saying:

    "We are pleased with this result, which reinforces the principle that search engines aren't responsible for content that is published on third party websites. Mr Justice Eady made clear that if someone feels they have been defamed by material on a Web site then they should address their complaint to the person who actually wrote and published the material, and not a search engine, which simply provides a searchable index of content on the Internet."

    This case was heard at the end of July 2009 - so is fairly current in terms of law.

    There are other search engines as well as Google. Are you going to contact Microsoft and ask that this forum is removed from their search engine - Bing. Before they do that they would want to read this thread - is that what you really want, since their Windows EULA prevents anyone making ANY copies of their software for whatever reason.

    Time and time again, when a company is criticised one of two things happen.
    The company may come on the forum, usually not, but will always do their best to sort problems out, or answer reasonable questions or concerns.They work hard with the customers to acheive a good result.

    Then we have the companies that are sailing close to the wind.Their first response is always to threaten legal action, and want the forum closed to prevent any criticism of its tradng methods. When this doesn't happen they start making personal threats against individual posters in the hope of silencing them.

    I leave others to judge which category XL fall into.

    Can't we just ask Google to not have their spiders link to quite clearly a fraudulent website.

    Before XLT says I'm being defamatory, I'd like to bring to his attention that he is not only selling a 'Copy' of Windows 7 Ultimate edition, something that hasn't even been released to the general public, so how someone can already own their own copy I don't know, but for a very very low price, he is giving away Adobe's Full CS4 product, with everything included, amongst other 'backups'.

    I have an idea has anyone contact FAST yet, I phoned them once very nice people. Might be worth a call, plus you get cash for helping them catch people :)

    sorry to add to this huge thread but if it was legal, that 2-post wonder 'from' xl trading wouldnt offer you 'all sky packages' for 40 quid, they would merely copy your card for you as a back up.
    but of course no one sends in their card to be copied, as sky do this for free if your card was to be damaged.
    still, money is easily taken from the ignorant and dumb
