    We are not gracing this forum with replys anymore, everything can be explained over at our place but since non of you wish to partake of our little challenge (cowards) then there is nothing more to say really :)

    If you are not gracing us....why are you still....gracing us with your presence?.

    We have taken this matter to a higher power now and since MSE do not care enough to remove the thread for you - we we will have it binned by Google themselves who WILL delete this thread from being spidered and from showing on search engines.

    So the 'higher power' is Google?. You clearly cannot remove the posts from MSE becuase they are factual and correct. Good luck with Google.

    Anyone can file a defamation claim XL, winning it is what matters and US libel laws are different to UK ones. The article you link to makes it clear that Google have not actually removed the content (why would they, no laws have been broken) and so a fairly pointless article really.

    Well, it has took you all weekend to find the actual law. Perhaps we can all post various Acts...come to think of it, we've posted the Companies Act on here to show where your website was illegal, not that you've changed your website yet.

    How can you sue for defamation when you have accepted the website breaks a number of laws?. No lies, therefore no defamation. Blime,y your 'team of lawyers' must be charging you a fortune for all this - should have come to MSE and saved yourself a fortune.

    Even in the US I believe now, a celeb has gone full pelt in order to get a bloggers details.

    UK and US totally different and again - but then you know that as you are the libel/legal expert.

    XL, every post just shows how little you know about anything - you cannot even get your own T&C's on your own website correct.

    All you had to do was put your trading address on the website - a 5 minute task - which you agree is required as you are (or represent) a trading and VAT registered company.

    If you'd done that a week ago, there'd be no need for you to do anything, make threats (empty, but funny nonetheless) or spend your weekend googling US law (but we're the UK :confused:) last time I checked.

    Although it's been amusing to read this, it is surely well past its due time.

    XLTrading, you are in breach of the rules of this forum. It's not allowed to make posts spamming to promote a business (though it must be said your version seems unlikely to attract many). In addition, the place clearly does not like discussion of certain issues related to the legality of copying software

    And you still appear to have no concept of the principles of defamation law. An assertion that is provably true is not defamatory.

    Your attempts to conceal your company's conduct by asking Google to remove discussion of it may backfire, if they do so, as that is how people discover new products

    The Sky product seems to have been removed from sale on your website, and you also have a warning to existing customers about a loss of service on theirs, for technical reasons which you are negotiating with Sky.

    These are both plainly observable facts. If people from here notice, and blankly say so, that is not defamation.

    Are there any other products that are likely to disappear from your website?

    Using marketing material, including pictures of a product, may be viewed by some of those companies as a breach of their copyright.

    If these are not the actual product, but only a copy, it may also be a trades description issue.

    Your opinion, that people are allowed to copy software for their own use, may be viewed by the software rights holders as not extendable to retail sale of copied products, if that is indeed what you are doing.

    You ought to save the effort of making petty threats of legal action against MSE and its forum members. If you actually have lawyers, they may be quite busy when companies such as Microsoft Sage and Adobe start investigating your trade.

    They are also selling copy DVD's without showing proper BBFC certification on the website - it is an offence to sell any movie/TV programme on DVD/disc without appropriate certification being displayed.

    Yes, these are "customer copies" but the website has no checks to ensure that an underage person cannot 'obtain' these films.....and the website sells hardcore adult movies so another report going off this morning to the BBFC for infringment of several laws including the Video Regulations Act of 1984.

    EDIT; Users on here should be mindfull about what they type also - as we can easily ask Nominet for the contacts information and have a written report sent in validation on what 'salerio' has mentioned on here, which they are legally allowed to provide to us. We can ask Nominet IF any of the details in that statement made by Salerio were true and also keep a copy of the phone call OR get a written statement by them refuting such a post.

    Go ahead. As I said I am more than happy to give my contact details, preferably directly to your solicitors. Just have them contact me, you can email me through this forum or through the address I use to post on uk.legal.

    Unlike you I don't make threats when I make noises about taking people to court, I just send 1 letter before action and then issue the court papers 14 days later. This is what any solicitor tells you to do, all you do by posturing is to weaken your position.

    You seem to just bull*it and I'm calling you on it.
