There would be a breach of copyright because it is not a backup of their particular copy: it is a backup of someone elses original, therefore the buyer would be in breach of copyright for selling a backup copy of their own purchased software, and the buyer would be in breach for 'accepting a backup copy of someone elses original purchased software'
...2 identical computer games owned by 2 different people, for example, are not classed as exactly the same software. The owner has the right to make a copy of their particular disc, but not aquire anyone elses. Similar to a piece of software that has a product key to activate it: the product key distinguishes 1 disc to another, which makes someone elses disc a different piece of software to mine.
(Be aware I have metioned no companies, individuals or websites...therefore please dont sue me!)
The card is issued by sky & is a lawful copy.
Your arguement is irrelevent in this case. Not Again0 -
I suspect that this company is signing up new subscribers to Sky using false details. On receiving the cards, they send them to the customer to use. Once Sky realise that the bills are not being paid on these accounts, they cut them off, which obviously takes around 2-3 months.
If that is the case then it may come under the heading of "obtaining goods by deception".0 -
underlay_guru wrote: »It is completely relevant, and I think you are missing the point. I never mentioned anything about bootleg Sky cards!
.............
Prove to me that the use of these cards to obtain Sky TV and Sky Box Office services without payment or subscription is completely lawful and I will buy the lot from you:D
No. Its irrelevent.
Copyright doesnt come into it.
Even following your arguement its at best obtaining by deception & I doubt the user could be deemed to have deceived anyone.
As for breaking skys terms, that is not illegal, its civil. Its a break of contract to which the user may not even have had a contract. Not Again0 -
underlay_guru wrote: »-I never made mention to copyright either.
Whether the user has a contract or not is irrelevant. Sky TV is a product which can only be legally obtained if it is paid for. If it is being used but hasn't been paid for it is deemed to have been stolen, therefore illegal.
Incorrect.......Not Again0 -

What is relevant is that conspiracy to defraud is contrary to common law and can result in a custodial sentence: ask Mr Keith Cairns. The argument that there can be no criminality in supplying viewing cards which will deprive a broadcaster of its entitled subscriptions is simply wrong.
(As being pedantic seems to be the order of the day I have used bold type to highlight poor spelling.) :eek:RIP independent MSE.

Finally someone has shown some common sense!0 -

Incorrect again.
There is no offence in supplying viewing cards either.
I suggest you consult your legal team again. Not Again0 -
OK so do we know if the cards being sold are the new white ones?
Also it says:
"the card is totally ready to use and will be useable for 2/3 months dependant on how much is bought on the card"
What happens if you dont buy any Pay per View and just use the card for watching normal chanels?
Should the statement be:
"the card is totally ready to use and will be useable for 2/3 months dependant on how quick sky cut you off"0 -
Hi again!
Just to make it clear to whoever is banning us.. check what it says when you search for XL Trading through Google.. and I quote
XL Trading has permission to post and the right of reply on the forum however MoneySavingExpert.com does not endorse its products or services in any way
This is stated for all to see on Google.. you are breaking your own terms and conditions and your own site rules if you do not allow us our right to reply.
So we can now continue
We are not getting into any other arguments over whether this product is legit, illegal, works or any topic.. final answer from us:
1. The product works
2. Is NOT illegal in any way, shape or form
3. We do get the cards direct from Sky - legally, using NO false information (libel again on another post!)
3A. We DO NOT 'obtain these goods via deception' also... this is libel AGAIN.
4. The cards ARE the white new ones
5. They do last 2-3 months maximum.
End of lecture.
We DO NOT again, do anything illegal on the store hence our very good reputation on the net.
If you do not wish to buy a sky card from us, why even bother bringing anything up against us?
Or do you work for our competition - either way, it is pretty pathetic and low of all things.
We are not pirates also (people who sell at car boots purely for profit), we merely run a service which allows a duplication of an item you purchased legally. This is in no way illegal, hence we have not been closed down.
Read the terms and conditions on our site + also clients HAVE to agree legally anytime they order from us.. again, another legal disclosure which has to be agreed by a client - further protection for us.
Thanks
XL Trading ©Just to confirm, XL Trading does have the right to reply but this does not mean MSE endorses its products in any way and, like all other forum users, must help us keep the forum a friendly place to be.
