    I actually work for Debitas and Capital One and would be happy to answer any questions on how to deal with Debitas and to give advice on any issues you have so just leave them on here and Ill try and help you out!

  • If you are getting pressured to pay more than you can afford, or your offers are rejected, quote this:

    If you are not prepared to accept the offer I have made then I invite you to take me to county court, where my reasonable offer will be ratified. It should be understood however, that the commencement of legal proceedings under such circumstances could be counter to the 'Overriding Objectives' of the Civil Procedure Rules. You will be aware that the 'Overriding Objectives' underpin everything the court does. Moreover, paragraph 4 of the Protocols Practice Direction states that in the cases not covered by an approved pre-action protocols, the court will expect the parties "to act reasonably... in trying to avoid the necessity for the start of proceedings". I believe that I am acting reasonably in this mater, taking into account my current financial position.

    It has so far worked on a number of DCAs I am 'talking' too.

  • If, however: you feel harassment from a DCA then quote this in a letter or verbally to the person your talking to.

    Both this and my above advice have legal substance.

    'Since making my financial position clear to you, I have been constantly harassed by your operatives, who have attempted to intimidate me into making payments that I simply cannot afford to make, under my present circumstances.

    I wish you to know, that I am aware of my rights and that your constant telephone calls are a breach of Section 40 of The Administration of Justice Act 1970 and any further incidents of this nature constitute a course of conduct, which is a criminal offence under Section 2 of The Prevention from Harassment Act 1997.

    Please note, that whilst I take my obligation to you seriously, I will not tolerate such abuse, and if I receive any further telephone calls from your organisation, I will have no hesitation in reporting the matter to The Office of Fair Trading, whom you may be interested to know, are currently encouraging reports of this nature.'

    My wife and I are having similar problems.
    Cap one refused our payment of £16 pcm.
    Now Debitas are doing the same and asking for proof of income.
    As this is a non priority debt we have refused to send such personal material through the post.
    Now we are receiving 6 - 8 phone calls per day (landline and mobile) demanding that we pay the full amount or get taken to court.
    "I'm quite happy for this to go to court as you have constantly refused my offer." I reply.
    But the phone calls still come and the threatening letters still come.
    What are we to do??

  • I have been signed up with capiyal one for about a year and then moved address. I lost alot of things and completely 4got about my credit card. My limit was 500 which was maxed out. 6 Months done the line I finally received a letter at my new address and they have charged me an extra £350 because I hadn't made a payment within the last 6months.
    Now they have passed me over to Debitas. Which will be more fees. so i spent £500 and will have to pay back about £900. Is this right? When I finally hear from Debitas I will arrange a payment plan of £100 every fortnight. Do you think they'll accept that?

    I've had people phone me on my home number, then asked me to confirm my home number as a security question before they can divulge any information.. so I've said 'you should know it, you just called me by using it'. I then get 'sorry, you need to confirm who you are or we can't discuss anything with you', so I say 'fine, I didn't ask you to phone me anyway, good bye' and put the phone down.
