  • I have been dealing with Debitas for a few months now - I have phoned them twice in the past few weeks to ask for payment slips as I have now run out - twice they have said they will send them and I still haven't received any - how am I supposed to keep to an agreement if they keep breaking theirs?

    I am completely at my wits end with Debitas, no matter what I do I cannot seem to get my account resolved. I cannot pay the £583 due to a change in circumstances at home and have offered to pay £25 (truth is I can only afford about £10) but they are insisting that I pay £58 a month and just do not have it so as a result I have not been able to pay them anything, I tried to make token payments but kept getting told that it wouldn't be enough so they won't take my money at all.

    They also told me that they would send me a standing order form and I planned on setting it up for £25 per month and then at least I was showing that I would be willing to pay something, twice this has not arrived. Today I spoke to them again and the woman finally relented and said she could take £30 today (I said it was still too high for me but I am a wreck over the harrassement they are giving me that I have paid it and decided to go without gas for the rest of the month) after I paid £30 she told me to ring back in 2 working days to see if were willing to keep my account with Debitas or pass it to someone else who would visit my home for the money.

    I just sat and cried after this phone call, they ring me between 4 and 7 times a day, they keeping calling me at work and now I am in trouble with my company as we are not allowed personal calls, I have asked them to remove my number because of the trouble I am in and yet they still continue to ring my work at least once a day - I can't cope any more, why are they doing this to me?

    Hi Babydoll,

    It may sound easy enough to say, but do not let them get to you; they are trained to simply get the money back in at ANY cost.

    The first thing I'd advise you to do is stop talking to them on the phone and, instead, put everything to them in writing only. You'll then have a paper trail of everything said between you and you'll find that they start to become friendlier mmmmmm. This also puts you in control and you won't have someone breathing down your neck trying to force you to pay more than you can actually afford.

    You should sit down over the weekend and work out how much you actually CAN afford; not what they dictate you should pay. Once you've worked this out, put it in writing and send recorded. It's then a case of waiting for them to reply to you.

    Stay in control.

    Use the complaints addresses to send them recorded delivery letters telling them to stop ringing you at work as this constitutes harrassment - they are not allowed to harrass you in this way if you have written to them stating you do not want phone contact. If you are in work simply state you are not speaking to them while you are in work - they cannot have money that ypou do not have - do not let them bully you

    Okay, I am going to merely speak common sense to you and anyone else who read that post above. It is for your OWN protection after all.

    a) What guarantee have you got that the person actually DOES work for Capital One?

    b) None

    c) I am a brain surgeon in my day job and by night an astrophysicist.

    d) I'd strongly advise NO one go to giving out details of their debts to someone in this manner who claims to work for so and so DCA, creditor whatever. Because, even though someone might say they work for so and so ... do they really have your own best interests in hand?

    I really would exercise caution as that person could be literally anyone.

    Capital One IS Debitas and they are NOT a DCA; they are Capital One's arrears department but will try and kid you into thinking they are third party. That is useful for anyone else dealing with them BTW not just this thread.

    My next piece of sensible advice for you BB81 would be to speak to Consumer Credit Counselling Services to get advice about token payments, sending offers of payment and so on.

    It's entirely up to you what you do next. Completely up to anyone. I'm not here to tell you what to do TBH.

    I have just looked up DEBITAS on dunn and bradstreet. It does not exist.
    Why are you paying money to a company that doesnt exist.
    For a company to exist...it has to be registered with companies house/dunn and bradstreet!!!

    Further more, in order to have to pay someone, there has to be a contract. (this is only the case if the debt has been bought from the original company!)
    The original company is no longer interested as the DCA has paid them.
    The DCA has no contract with you saying that you will pay them anything.
    The reason they ask for info is for you to agree to being the PERSON (business name, ie MR JOHN SMITH) instead of your human name john of the smith family)
    This creates contract between two business parties.

    And why are so unwilling to acknowledge there mistakes such as not updating there systems?
