My wife and I are having similar problems.
Cap one refused our payment of £16 pcm.
Now Debitas are doing the same and asking for proof of income.
As this is a non priority debt we have refused to send such personal material through the post.
Now we are receiving 6 - 8 phone calls per day (landline and mobile) demanding that we pay the full amount or get taken to court.
"I'm quite happy for this to go to court as you have constantly refused my offer." I reply.
But the phone calls still come and the threatening letters still come.
What are we to do??
They are !!!!!!- the only time you need to provide evidence of your income is if they issue a CCJ.
They have no right to ask for it and no right to that- try and find a way of playing them at their own game- re zincoxide!now debt free and determined to maintain good spending habits and build savings0 -
Yeah I had an account with capital one and they send it to debitas. I still have it on going and I havent had much trouble with them. Had a 500 quid limit with cap and charges pushed it up to around 800 quid. I agreed with debitas in october a payment plan of £50 to which the idiot said "that would take a long time to pay off" well no !!!! sherlock but thats life!! I think I missed a payment in december and got a couple of calls but never returned them and havent heard anything since. The balance should be around 300-400 quid by now so will have to check as I want to enquire about settlement figure.
It saddens me when I hear about people getting streesed and upset by !!!! ants like these - the rules and regs are there so exploit them!! But when people get stressed sometimes comments like this are easy to make so I hope people get sorted soon!!

I have just looked up DEBITAS on dunn and bradstreet. It does not exist.
Why are you paying money to a company that doesnt exist.
For a company to exist...it has to be registered with companies house/dunn and bradstreet!!!
It can be a trading name (i.e. Capital One PLC T/A Debitas Legal Services). When you go to Tescos, you're purchasing goods from Tesco Stores Limited, however you don't see that anywhere apart from the receipt, because Tesco is a trading name of Tesco Stores Limited.
Furthermore, you or I could immediately start a business called Dave's Furniture, and in the eyes of the law it would be wholly legitimate, as long as we kept the accounts up to date thereby paying our taxes. Registering with Companies House is (most of the time) only for the purposes of the directors getting limited liability (http://en.wikipedia.org/wiki/Limited_liability).0 -
Yesterday a man came round from Debitas, I said the person he was looking for wasn't in and I would take a message. He then said he was a Bailiff from 'the courts'. I haven't received any letters from any court. Only angry ones from deibitas. Am I right in thinking he was just trying to scare me? and that he is simply a debt collector from debitas? I am currently going through a debt relief order which can't be processed if I have any county court judgements. How long does it take a company like debitas to issue a CCJ if indeed they can?

This is a bit drastic but it works - get BT to ban their numbers. BT have a facility to ban up to 10 numbers to your phone. I did it with SKY Talk - cost £3.35 per month - but well worth the peace and quiet - gave us a little breathing space as Capital One and Debitas are persistant little beggars.
Even if you are pleasant and polite to them and you agree a payment plan, they STILL call at all hours. Block the arseh*les. If you want to make a complaint direct to Capital One try this lady....

Having had the "choose to refuse" put on my line, things went quiet. Until yesterday, when the crafty beggars "with-held" their number. At this point I did what I had threatened to do previously and reported them to the Financial Ombudsman - sent Mrs Ellie Renshaw a fax confirming this and gave her the FO reference number for good measure. Absolute silence!!!!
I owe £385.63 and I made a payment of £25.63 with a Standing Order for £20.00 to follow. Cheeky bleeders wanted another £1.07 on top of the £25.63 to ensure that " a mutually acceptable payment plan could be set up". Yeh right. I firmly believe that this is a control thing with them - they hate not being in total control - stick to your guns and B*ll*x to them. I have also told them that the cost of the "choose to refuse" will be taken out of the monthly standing order.:rotfl:0 -
Just had to ring Debitas, yet another letter threatening me wth court action, apparently they got a payment 4 days late which means I've defaulted on the £25 a week payment plan I set up, when we finally got around to re-instate the plan she ( Miss Thomas) told me that by 1st November the payments would be over £84 in arrears, I took that as a refusal of my offer and quoted the legal stuff on here, she hung up !!. So :
a) I still don't know if I have a repayment plan set up
b) Will they continue to send me letters, ( Letters to my old address, which I only get because I'm a postman...LOL)
Have written to Ellie Renshaw to see if that cures anything.0 -
Just got a letter from debitas,on reading the forum's and other people's case's mine is just the same.I am going to write to them but to which address ?the capital one or debitas in Nottingham?Going to be sending all letters recorded for proof of my payment to them giving NO phone numbers but I do want to pay.Capital one came down from £37,to £20 then £10 to stop it going into default,fine was going to pay £10,they gave me 2 working days all happened this monday 04/01/10 by 05/01/10 the nest day I received the letter from Debitas,so I could not pay the £10 to stop going into default.0
