Debitas

Ok, recieved a letter today from Debitas Legal Services, saying as I haven't responded to them etc etc. I called them up, the woman asked me to give her my two phone numbers for security. Told her my landline is ex directory & I won't give out phone numbers. She argued saying so she has two numbers & I won't confirm them, so she can't speak to me. I said well choose something else to ask, you managed to write to me. She said she has my work number & will contact me at work, so I said well i'm saying not to & if you do i'll consider it harassment. Anyway, I have sent my card back & offered £25 a month, which I didn't tell her. I just said i'm going with CCCS, so she told me to hang on while she checked if they deal with them. She then told me that I have to pay, so I said i'll make token payments of £1, to which she said it HAS to be £10. Came off the phone really upset, tho I did hang up on her lol.I'm just gonna send the £1, wish I'd asked to speak to a Supervisor, what do you all think?

    Mind games hun, the whole thing is a fabric of lies, half truths, deceipt and mental stress to get you to pay more.

    You are correct they can't hassle you at work, and if they do report them. Only deal with them via letter, ask for all your phone numbers to be removed from their system. Make a payment offer YOU are happy with and ignore what they want. They may ask you to submit a SoA to them and this is optional, personally I never did to any of the 25 DCA's I've dealy with and had no problems.

    Don't arrange a payment amount with them, set it up as a standing order for something you are happy with, then also make a one-off direct transfer of the same amount so they get something in their bank and on computer before you contact them. Leave it a couple of days then write to them to inform them of the payment arrangement, not to negotiate one. You can offer as little or as much as you want, they can't reject it. If they did, and it should ever go to court, the judge would have a skitty because they have a duty to avoid legal action, the DCA knows this.

    Every now and again, after they begrugingly accept, they will hassle you to increase it. Just tell them you will if you can afford it and leave it at that and they should stop pestering you.

    lol I dunno if they're a debt collection agency or a solicitors, Debitas Legal Services is the name, in Nottingham, but I googled & can't get any info except that it deals with Capital One

    Found Debitas to be very unhelpful. They contacted me regarding a Capital One account and told me I had to pay them straight away. Told them I would make a token payment and I they tried the harrasment with me.

    2 days later they contacted me to say they were passing on this account and not dealing with it any longer. Were very rude to me and said it would be my fault if I got taken to court.

    Sent them a complaint letter but never heard another word from them.

  • I have just had a head to head with somebody from Debitas. The person concerned was rude and overbearing.

    I have been paying an agreed monthly amount to them and never missed. I rang them a couple of weeks ago to pay the usual amount and got a chap who insisted that I send him a new Income/Expenditure report etc., and that I would have to increase the monthly payment etc.....
    I (foolishly and because I was feeling stressed and intimidated) agreed to pay £10 instead of the usual £6 - not that I can afford it really. And to forward a new Income/Expenditure report....At the time I was unwell and was being treated for a suspected dental abscess and assured the chap that as soon as I was up to it I would update their information. I duly made a £10 payment which, of course, was accepted. He did call again a few days later but I was still unwell. Today another chap called and was absolutely dreadful. He was obviously untrained and I found him threatening and patronising - as I have sons who are probably older than him [and whose ears I wouldn't hesitate to box for being so rude] I will not be spoken to in that manner.
    It ended up with his referring to me as "Madam" which put my back right up and threatening me with court action which would result in further costs etc and leave me with a CCJ. Afraid I said "Fine, Just do it" and hung up.

    I did call back to ask them to forward an income/expenditure form but was told (I suspect by the same young man) that as from today Debitas were no longer dealing with my account and it had been referred for further legal action. So looks like I'll have to await the coming of the CCJ.

    It's strange because when I first dealt with Debitas rather than Cap. One, they were so helpful - the lady who dealt with me was polite and empathic. I rather suspect that the chaps I have spoken to over the last couple of weeks are either "newbies", students working over the hols, or some such. They will, in turn, no doubt be under pressure to get as much in as possible etc.

    Do I have any come-back if they do apply for a court order?

    A CCJ is a court directed payment plan. An IVA is one you've set up without the court's direction (usually through a DMP company but not always). If you can prove to the judge that you have been making payments under a voluntary arrangement then I suspect that he will almost certainly help you and award costs against them and probably give them a telling off as well.

  • Oh I can definitely prove payments. They've all been made thru my bank and will appear on any statements etc.
    Now I'll have to find what "vexatious litigant" is!!

  • they are a debt collection agency, capital one use them, they are hounding me for money left right and centre :(

  • We know we owe money... we have tried to talk with them. All they do is threaten us with court.

    They need to write as my hubby works away from home all week and they say they cannot take instruction from me. He has told them not to phone as he works away from home.

    We tried to agree a payment with them but they kept saying it had to be more. We genuinely cannot afford more than £25 per month and so far have gone ahead and made this payment anyway. My feelings being ... at least we are making some effort to clear the debt.

    Why are they allowed to get away with keep calling - sometimes 3 times a day?? I am normally at work but I am TRYING to recover from a major operation and this isn't helping !!

    If I am at work they get my young daughter, they upset her by saying she has to give another number for them to call.... Thankfully she is sensible and will not give any numbers out to anyone.

    Surely there is a way of stopping this harrassment .... ANY ADVICE ??

    You all need to read the OFT Guidelines for debt collection

    Demanding unreasonable payment, telephoning at work, insisting on telephone contact and frequent phone calls are all out of order. Write to the OFT and to the trading Standards nearest the office that are haressing you.
