DOES ANYONE KNOW FOR DEFINITE IF LPS CAN TAKE COURT ACTION OVER PARKING TICKETS? tHEY HAVE GIVEN ME ONE FOR STAYING OVER FOR FORTY MINUTES!!! I think this is disgusting! Help please if any out there . . . thanks
Anybody can take anyone to court. Never heard of these clowns doing court. Remember that the charge is unenforceable anyway, so why would they bother with losing in court?0 -
Still only on one letter but just like a bus there should be another one along shortly.
It is worrying to get these letters and will be glad when they stop but all the help and advice given on this and other sites is very reassuring. So thanks all and keep up the good work:beer:0 -
I got one letter from Brethertons threatening court action in 7 days if I didn't comply which I filed and ignored.
I have heard nothing since. That was six weeks ago.
So hold your nerve people nothing will happen.:j

Hi guys,
Can someone please help me?
I recently parked in a car park in Birmingham and came back to my car to find a Parking Charge Notice from Local Parking Security Ltd. I'll be honest, the car was parked with a valid disabled badge which is registered to a family member who lives with me but they weren't present (bad I know, I wouldn't normally do this but only did this time as I was parked up for 5 minutes and thought it would save me the cost of paying and displaying).
I've read all the advice on here and I'm considering not paying the charge, the only thing that worries me is that the car is a hire car we have for 3 years and is registered to motability, the only people allowed to drive it is myself and another family member (no one else can drive it even if they are insured third party). Do you think they would take me to court as there is a good chance they can prove I was driving?

Do you think there is a chance of them taking it further though because only 2 people are allowed to drive the car, one is male and the other is female. I'm male and if they saw me they'll know it was me.

Even if they can prove who was driving they still have to overcome case law from 1915 which states that they cannot charge a penalty under contract. Plus the fact that blue badges do not apply in private car parks anyway.
