It does say on their terms which is at the end of your order that "orders are not accepted until they are despatched" so they are not under any legal obligation to offer you the goods at the missprice but they could have just sent so many out by accident or a a goodwill gesture for the first batch etc...
It's wrong for them to keep hold of money and it would be good if they offered some money off vouchers to the customers that never received their orders.
More companies are now using the same policy as it is a last minute get out clause in case of a missprice or oversale on goods so the company can just say they cannot obtain the goods at the missprice but they could offer you them at the normal price or just say order was cancelled as per terms which you agree to when you place your order0 -
What a fanstatic idea !
Create own company on website with non-existent goods which have bargains that r too good to miss, get loads of orders taking credit card payments, keep it in a bank for a month then send everyone their money back and then keep the interest.
Sounds so easy that there MUST be a law against it ?

Guys,
NO MONEY has been taken from your account.
Those who received the kit will have the money duely taken from the account.
Those who have not received the kit, the money is on hold in YOUR OWN account. No one has taken your pound. Ring your bank, it's on hold waiting to transferred soon as Tesco accept the transfer.
If it says somethng like "Debit - Tesco" then money has been taken from your account and you may have a case that Tesco need to provide you with the item at that price - but then again they will say it's out of stock.
Other than that, it seems some are trying to create a storm in a tea cup.0 -
I got the 'sorry but' email too.
Just rang Tesco's customer services - 0870 607 6060 - said I'd had the 'sorry error' email, and was told no problem my order has been accepted and I will recieve as soon as new stock arrives.
No money has been taken from my bank, and CS girl confirmed price £1.00 free p+p.:grouphug: A smile, a 'please' and a 'thank you' cost nothing0 -
There are three things needed to create a contract and all three must be done.
1) An offer, this is the offer to sell these Dyson party clean up kits at a £1
2) Acceptance, this we have done by giving our card/bank details for them to take the £1
3) Consideration. this must be something of value exchange in this case the £1 this has not been done as I think you will find that Tesco have not actually taken the money and only do so when the item is despatched.
