Did anyone receive their Dyson Party Pack for £1.

Mine never arrived, even though I received a confirmation e-mail saying it would be delayed. The £1 never came out of my bank either. :(

There are three things needed to create a contract and all three must be done.
    1) An offer, this is the offer to sell these Dyson party clean up kits at a £1
    2) Acceptance, this we have done by giving our card/bank details for them to take the £1
    3) Consideration. this must be something of value exchange in this case the £1 this has not been done as I think you will find that Tesco have not actually taken the money and only do so when the item is despatched.

Just checked my Tesco account and the item is still open but no money has been taken from my credit card as yet so I might still get it but if not no hassle !

Please note - This is a somewhat simplistic, inaccurate analysis of the situation.

    In fact, it's totally wrong.

1: Invitation to treat - advert on the website giving the price as £1 for the Dyson Party Pack.

2: Offer - we decide to purchase the item for £1. Fill out the order form, give our credit card/debit card number and press submit.

3: Acceptance - According to Tesco's T&Cs acceptance takes place when they take the money. They only take the money upon dispatch of the item. In other words, there is no contract until they've taken the money and dispatched the item (as they say they do not take money until dispatch). If, however, they take the money (and by that, I mean it leaves your bank, as opposed to being held pending being taken), then the contract exists. However, they should not do this, as their terms state they won't take the money until dispatch.

4: Consideration - the money Tesco takes when dispatching the item

5: Intention to Create Legal Relations - it's an online business. No need to worry about this one!

So, unless Tesco has actually taken the money from your credit/debit card, you don't have a leg to stand on. Earmarking the money is not the same as taking it.

Have just had the following email come through, completely contradicts the earlier one

"Thank you for your e-mail regarding your order.

We regret to inform you that the item is still on reserve, however it would appear that we are experiencing problems obtaining further stock and at this stage, we are unable to guarantee that stock will be available.

If and when stock does become available we will despatch this to you.

Please accept our apologies for any disappointment caused."

    My order status says:

To track your electrical order, please call 0870 607 6060

and I've never had any e-mails. I don't think I'll be getting any clean up kits even though I ordered early that evening.

Ditto, in the same boat as you. To be honest I never expected to receive one, but you never know. You win some you lose some eh. :)
