  • Just a wee update on my partner's claim.

    Had 2 letters from the bank stating they wee dealing with backlog and would respond within 4 weeks and the last letter which cam in on sat there provides address for FOS stating we are within our right to complain...

    will have a wee route around and look for the FOS template letter and try put an end to this saga.

    Further update on this one folks.

    FOS called today to say that the information provided was "Very Comprehensive" and did we have anything further to add.

    They said they could not discuss over the phone details of the case although our bank will have a response to us within 10 working days.

    So fingers crossed that we can get this one settled.

    Thanks for all the help folks and we will update further on the outcome.

    I sent my claim letter to the Clydesdale bank on Monday. They PHONED me yesterday asking a few questions and said that i will recieve a letter within the next couple of days and that they are investigating it.

    I suppose the 'letter' will be that questionaire ! :(

    Quite possibly.

    To be honest the questionaire wasnt that bad, its the constant letters of thanks and how busy they are and we are sorry we havent sorted this out yet.... blah blah blah!

    Hopefully we can put an end to this one and move on...

    Will let you know how we get on.

    You may receive this tomorrow then, do not worry about it, this I take it is procedure, also you do not have to correspond with them on the phone, you can tell then you will only accept written correspondence (this way you have this to fall back on in case you need anything for evidence such as for the FOS, for instance if you was not happy with the outcome you send copies of written evidence to the FOS).


    Also as Wullie have said the Questionnaire was not that bad, If you received this then just write to the best of your knowledge, write next to the questions "please refer to my letter" and/or please refer to my account.

    hiya.

    10th March the Ombudsman called, spoke with sharon and said that he has reviewed the account and will be writing to the bank to instruct them on their judgement.

    Guy at FOS said sharon should expect to hear from the bank in the next 10 working days.

    Letter from Clydesdale today stating that the claim is upheld we have no proof that the policy was mis-sold and the integrity of their emplyee remains.

    Funny thing though tha=ey have attached the PPI for where the bank rep has wrote word to the effect of " Miss XXXXX confirmed she has no existing insurance in place, Payment protection is a requirement on this agreement"

    Awaiting to call the FOS back on monday to discuss further, I'm sure if they had ruled in the favour of the bank kthen this would be commented upon via bank correspondence? or at least a letter from the FOS explaining the ruling?

    This is quite confusing and a real pain! however we will push on...

    Hi Wullie, thanks for your update.

    That is good news they have upheld this for you, in this case they should refund all you have paid, interest, and 8% interest of what a court would award for being deprived of your money.:T
    It looks like because they have nothing on record of the sale, they are upholding due to this.

    They have said that they are not paying up as the policy was not mis sold!!

    The comment on the PPI for reads "MissXXX currently has no cover in place therefore protection is required for this loan" Signed by the bank Rep and sharon.

    Surely this information confirms the fact she "WAS" told she had to take out PPI?

    Will chase up the FOS on monday and see if they can look at it again? we really did think they would rule in her favour, their leaflet explains that they would inform you of the reasoning for a decission against you or alternatively contact your bank for a decission in our favour and instruct accordingly.
