    Hope you had some sleep.

    I can't add much but I started reading this thread last night and have woken up thinking about you.

    As someone has already said, get the contract checked out. What happens when the parents go into care, do you have to sell your house to pay for them? How must this go on for? They are in their 70's, and they could live another 15-20 years. What a nightmare!!

    Renting for Pete and you seems to be a good option, pay your debts off (might be a good idea to offer 80% full and final payments when you have the equity released) and that will give you some breathing space to then think clearly about the house Pete's parents are living in. Just hope the contract drawn for Pete's parents wasn't water tight.

    Not much to add to what all the other posters have said, although obviously you get the hug :grouphug: (first i have give on MSE, don't give em willy nilly you know;))

    Personally, i would look into selling the flat the in-laws are in before selling your place. If you can get the rent free contract voided, then sell it from under them, they have got other kids so they shouldnt go homeless.

    The money from that sale would take a massive chunk out of your credit card bills. Then sell your current house, you would be able to pay the remainder off your cc bills and possibly buy another place to start afresh in.

    Well I got to page 3.... :) Sorry but there is so much information that I won't be able to take it all in in one sitting :)

    Hun I hope you are ok and look at all the people here who want to help you :)

    My 2 pennies worth: Go get legal advice! Find any loop hole in that contract about rent free for life that you can! I am sure that under certain circumstances you will be able to default on it as it's unreasonable and frankly I don't see how any judge if it came to that would find otherwise. You have provided tem with free lodgings for a LONG time and now you are financially no longer able to pay for them to live where they want. If they can afford luxuries then no judge I can think of would find in their favour if you two are staring at bankrupcy.

    My first line of action however would be to sell your own house and pay off as much debt as possible and rent. This would cause the least emotional pain for you and Pete I think and as many here have said... they'll pop their clogs soon enough ;) and then you have a fairly sizable lump sum you can put towards a home for you two together :)

    Or when you feel emotionally stronger after selling your own home and settling your debts THEN get legal advice on evicting them. explain that due to their unwillingness to help at any point or be even slightly reasonable then you have had to sell you own home just to keep your heads above water and it affected your health etc. The only reason I would suggest selling your home first is because I don't think looking at your posts that either of you are strong enough right now to fight these blood sucking OAPs... And I thought my family was bad :(

    What a terrible post and your MIL must be a really horrible person - I really feel for you, I would also suggest that you are one of the few people where an IVA would work - you have £140,000 in cc and loans but you do have surplus to pay towards them.

    I would ring Paypal asap because there really could be light at the end of the tunnel for you, it would also protect you and your properties from your creditors, you debts would be paid off before you OH reached retirement age.

    I wouldn't normally advise an IVA but this would work in your case please please do call payplan I believe they can and will help you and pop back on the board so we know you are ok. You can find out more information on this site

    My feeling is if they sell off thier home & rent ( thus clearing the debt) , surely the judge is less likely to be falling on thier side, as bankrupcy is less imminent and they are debt free

    My feeling is that if you remain in debt but via an IVA or DMP for example. then the judge will be able to look at them and go, gah they COULD go bankrupt here

    What does anyone else think about this tension?
