    Make sure u keep a record of all correspondance u have with them (emails etc) because u'l probably have to take legal action against them and this will help support ur case. I issued a court summons and they did not even acknowledge it within the time they had to reply. Ive requested immediate judgment by the court so hopefully they will be ordered to pay soon.

    got a contract with MR sent off for 3 cash backs not recieved any money. made false promises on each time
    can some please advice me what to do. who do i conact and what evidence will i need to get my money out of them

    UPDATE
    Got copy of their defence yesterday along with Allocation Questionnaire.
    Their defence is inaccurate, contradictary, and quite frankly, extremely week. Shall be sending Allocation Questionnaire off on Monday, along with a faxed copy to Mobile Rainbow.

    I know Quentins advice is probably not to contact them from now. But in my experience in some cases, by following up and keeping the other party aware that you WILL be continuing this action, it may generally force a settlement payment before it reaches court. It can also be seen as favourable by a judge that you have still continued to try and resolve this matter before a hearing. So will basically be offering Mobile Rainbow one last chance to make a final settlement before a court hearing date has been set.

    Again, will keep you updated.

    PS. Next on list is SIMPLY 3G, as my wife will soon be due her 1st cashback. I have read other threads that they are also struggling and making payment offers. Not interested - shall be claiming for the whole lot - if they go down, so be it - the quicker these types of companies fold, the better for anyone else before thay are sucked in. If i'm going to lose £300 in cashback anyway, i'd rather spend another £25 to help send them down.

    If you are going to send them a copy of your allocation questionnaire, then this tactic is worth considering (or would be for a "normal" defendant, though this outfit seems to ignore everything but court orders):

    To show you mean business send them a copy of your questionnaire prior to sending it into the court, saying in a covering note that you intend to continue your case, and that unless they pay you the balance owing from your claim within 7 days you will lodge the questionnaire, thereby giving them the chance to avoid paying any more court fees and expenses (the hearing fee plus your out of pocket expenses for attending the hearing and any loss of earnings you intend to ask for).

    Letting a defendant see your questionnaire does not lose you any advantage as they will be sent one by the court anyway.

    UPDATE.

    After filing a CLAIM, Msols did the usual delay tactic as some mentioned. They filed a defence.

    So as per advice that I have been reading, I sat back and waited. Just recieved a letter this morning where they have claimed that the money £120 + £25 costs has been paid into my account which my bank has confirmed.

    So a big thankyou to all the people on here, I could not have got my second installment without you.

    Now the main issue, the final payment of £120. Admittedly I put in the claim way way too late as I lost track of time due to the second non-payment. Is there a way I can try to get that back ? Do I close this case and start a new one ? What are the chances that I will actually get anything from them ? Or should I cut my losses and move on ?

    Because of errors on my part I've lost some/all of my cashback
    Looking for a little advice please.

    MR Received my cashback claim on 10/12/08.
    I emailed them on 20/12/08 to ask for an update and received this reply
    Dear Customer
    Thanks for your email.
    This is to inform you that our records are not updated with the claim received, kindly get back to us within 7-10 working days for the update on the same.
    In order to ensure you are getting the best possible advice and customer service please call our web sales support team on 0870 801 3651 where one of our experienced advisors will be more than happy to help with your enquiry.
    For future reference please provide us your order id, post code or home telephone number to assist you better.

    I emailed them again on 8/01/08 asking for an update and received this reply again today 12/01/08

    Why !!!! around with these crooks? As soon as the day arrives that you should have been paid under your t&c send a LBA then sue - IF you think they'll still be around to pay up. Or perhaps you haven't bothered reading this thread?

    I got stung by phoneboxdirect and dont want to get stung by these guys too.
    Was just looking for a little advice....isnt that the whole point of this forum....to help each other?!

    If I'm harsh it's because people ask the same old questions and expect people to answer 100 times when the answers have been given more than that already. Why is it that people who don't want to invest the time to help with their own problems expect others to spend the time helping them instead? I have helped a great many but draw the line at becoming a parrot! In addition, since you've been "stung" by Phoneboxdirect you should already know what to do in this case - all the answers are on those threads too!
