    Oh, the money claim on line is down till 1st jan! so i will have to wait.

    Quentin: who do you issue the claim against, is it the name of the company. i.e MR or a person?

    Hi

    Am trying to speak with Mobile Rainbow as my first cashback claim is due to be sent to them just now. Their website says that they work Sundays 9.30-6.30, but the phone number (0870-801-3651) doesn't connect and I get the unobtainable tone. Anyone know if they are still trading?

    I think they are still trading - but if you check the mobile rainbow website teh company name at the bottom has changed....

    But they are still up according to companies house.

    I got this on Friday:

    Dear Customer
    This is in refference to the complaints letter we have received. We would like to inform you that you can expect your 1st cash back amount to be paid within 7 working days.
    In order to ensure you are getting the best possible advice and customer service please call our web sales support team on 0870 801 3651 where one of our experienced advisors will be more than happy to help with your enquiry.
    For future reference please provide us your order id, post code or home telephone number to assist you better.
    Warm Regards,

    My original letter said court on Friday and that's what I did - i received that at about 18:30 Friday evening...

    They are a set of <insert appropriate expletive>!!!!
  • I've received all cashbacks due with some (non-legal) pressure applied
    I have sent mobile rainbow by post & email my intent of legal action via the courts. This expired just before xmas abd I have not got around to doing all the required online with HMCS because they were down until new year.

    I have kept the pressure on MR via email and the keep changing the dates that they will pay me. (Latest 04/01/08 now been forwarded to account department for payments within 5-7 working days.)

    I have cashback payments outstanding on 3 account which are all at differents stages.
    1 = Last Payments (All others paid after constant pressure)
    2 = 2nd Payments (First payment made after constant pressure) I forgot to claim at 10 months - Silly Me thats 2 payments missed!
    3 = 1st Payments (I have now claimed 2nd & 3rd)

    I have today noticed their new T&C state they do not sell.

  • I had to issue legal proceedings to receive some/all of my cashback
    I'm starting legal proceedings today against mobile rainbow.

    Still waiting for my 1st lot of cashback on TWO mobile accounts despite empty promises from MR that the money will be paid and a heap of excuses about administration problems.

    My second cashback claim paperwork for TWO accounts appears to have been lost by MR who cannot verify its whereabouts despite Royal Mail confirmation that it had been signed for by their offices.

    I wish that I had never heard of this Mickey Mouse Organisation. They owe me getting close to £1000.

    Hi Bluebell,

    Go for it girl! I wish, like you, that I had never taken a contract with this set of scam artists! Mine is lodged with the court and I am just waiting for a reply. I've asked for the full amount for the term due to a fundamental breach in the contract (see earlier posts) along with my court fee of £35. I will wait to see if they try depositing the first cashback and claim the rest is null and void. Because of this I only sent in the 2nd cashback and I think I have missed the third now.

    Does anyone know how long the court gives them to reply?

    A minimum of 14 days - up to 28 if they ask for it.

    But don't expect a reply from the court (apart from a copy of the summons).

    As soon as the time allowed is up (14 days from service, which is 5 days after the claim is issued), and you have heard nothing you can ask for judgement.

    Don't give them any more time as should a defence be lodged prior to your judgement request, then the defence will take priority, even if submitted late (after the 14 days).

    Sounds like Mobile Rainbow have ceased to exist as a vendor of mobile phones.

    The change in trading name and registered company number is probably to protect their new business model from the influx of court claims which are being filed against the old company.....

    I recently filed court claim for whole amount against Mobile Rainbow after not receiving 1st and 2nd instalments and just sent 3rd. They have filed a defence which i have not seen yet, so will be passed onto court. Today, however, they have also paid into my bank £175 (being the first two instalments + £25 court fee). Ha Ha Ha. I will be notifying them a thankyou for Part payment of my claim and keeping the case open to go to court, otherwise i'll just be going through the whole routine again in a couple of months. Keep you updated.
