    Hi All,

    I am now very concerned that all my efforts will be for no reward! Having had a couple of PM's from some people I have been told that if your loan was taken out via Norton Finance then your claim cannot be looked into by the FSCS.

    Firstly, I do not understand why this would be the case, because in my case Norton only suggested that we use Picture as the loan provider and at no time other than the initail phone call did we ever speak to anyone else from Norton and in fact all dealings were carried out with Picture direct.
    Secondly, with this in mind the PPI and it's content were therefore never discussed or suggested to me by Norton so again I don't see what the difference would be (mind you Picture didn't really discuss the finer points either).

    I am now at the point where I have completed my complaint form from the FSCS and I was thinking about just not mentioning Norton and seeing what happens!

    Does anybody else have this same issue?

    I also only delt with norton on the first occasion, and picture after that but norton actually sell there ppi. The easiest way to find out if your ppi policy is with norton give them a ring and they will tell you who your ppi is with mine very unfortunately is with them so after many months and letter filling and norton saying they have not missold it i now have to go down the fos route so another 9 to 12 months sue

    it might just save you some time it took fscs 5 months to get back to me to say my ppi was with norton and as they are still trading it is out of there hands then you have to send a letter to norton and you have to give them 8 weeks and they took 2 days short of this to give me a very long winded reply to say they have done nothing wrong then you have to send there final respnse letter to the fos before they will investigate fingers crossed your ppi is with picture good luck sue

    Same here, just had a letter back from the FSCS stating that the insurance was sold by Norton rather than Picture, I did phone them and challenge this as I truly believe Norton just "passed me over" to Picture, they have said that since the final response from Norton details their sales process it must have been them.

    They have suggested I now take up with the FOS, which I am now preparing (after few days of total frustration, anger and tears, had, had a holding letter from Deloittes stating initial investigating had been made and now processing my claim !!! now FSCS say no as its Norton who is responsible and they still trading)

    Anyway, what I can not understand is that, Picture only seem to sell/sold their own products with their loans and my paperwork from them states it a "picture policy" so why then do I have no recollection of Norton selling me a Picture Policy or any documentation showing this ???

    All I can suggest is to take a deep breath and go for it, I see there is nothing else I can do but put my claim in the lap of the Gods at the Ombudsman !!!

    Did you get a letter from Deloittes in around about November last year explaining to you that Picture were in default?

    I really don't understand how Norton sold me the PPI becasue I had nothing to do with them after the first phone call and it was Picture's staff who advised me to take it out and that my loan acceptance would be affected by whether I decided to take out the policy!

    Have you contacted the FOS regarding the mis-sale of the PPI or do you have to go via Norton first. To be honest if the people who dealt with Picture have been successful I really don't understand how the policy holders with Norton won't be.

    I am so annoyed this is the case.

    Have you tried the telephone number for Norton above to see if they have record of your policy? I must admit I spoke to Picture the other week and requested a copy of my policy documents which they sent me with no problem. So again if this had been with Norton I am guessing I should have been directed to them at this stage?

    Sorry I am rambling.

    i spoke to picture back in november asking for my policy documents and the same they sent me them with no problem and i also have nothing with norton heading paper on like you am very angry have wasted several months and fos says it takes anything from 6 to 12 months i can not understand why back in november fscs did not advise me then sue

    I only knew Picture were in default from reading this forum.

    I contacted the FSCS to establish if they can look at my claim which they said they would and sent me the paperwork to complete, which I sent in on the 15th March 2010.

    I recieved a letter from Deloittes dated 23rd March saying initial reviews been completed and that they would be processing my claim shortly.

    On the 8th April they write to say "our investigations show that your policy was sold by Norton" and "This firm is still trading, which means we are unable to consider your claim".

    On Monday I rang FSCS to ask how did they know Norton sold the policy, ie what they investigated and what they found ? I was told that the letter I had included with my claim from Norton (a long standard letter stating how they sell) proves they sold the policy !!!

    I am now working on completing the documentation to take this up with FOS, but feeling less and less positive, I feel we have been totally stitched up and left with a policy for £22K for which I am still paying and due to expire sometime later this year.

    I do not have a policy document, well not that I can find, all I have is a brochure entitled "Picture Payment Protection" ???

    The policy is for joint cover, which is ridiculous because I was not working and am a carer for our disabled son !!!

    To me everything feels such a mess and I am really struggling to unravel all of this, it feels that everyone in the financial world is out there to trip you up and do their upmost to cover their ar*es with financial jargon and waffle.

    Please keep me posted on how you are progressing and if anyone can help or make suggestions of what or what not to do next I will totally appreciate it.

    Did you mention in your claim that you had dealt with Norton Finance? I am not sure what to do for the best now.

    I am tempted to speak with Norton on the number provided above to see if they have details of my insurance plan and if they don't I suspect that proves that the policy isn't covered by them.

    I also never received any paper work for me to sign or keep from Norton even when the loan was agreed.

    My plan of action is as follows:

    1. Speak to FSCS to see if it's worth completing my complaint form?
    2. Check with Norton to see if they have details of my policy?
    3. Send first letter to Norton about mis-sale of PPI if this is the case
    4. Contact FOS!
    5. Wait

    Must get back to the day job!

    I will keep you informed of my progress.

    Sounds like a good plan.

    The only thing I had from Norton was a proforma requesting basic details, such as names, date of birth, employment status etc.,

    I did mention in my claim that I went thru Norton, as that is the truth and the truth is that Norton passed me to Picture, therefore I feel Picture did the miss selling as they only sell their own products with their loans ! unless Norton is wrong here for passing me on to Picture ?

    Originally I wrote with my complaint to Picture who told me they had no information regarding the sale and to write to Norton as the broker, which I did, I have ended up with a letter from each as a final response and both were copied to the FSCS, who have then taken the Norton response as admitting to selling us the policy.

    I now wonder if I should have been underhand and not sent the Norton letter (not that it actually states anything personally regarding my individual case, but more of a standard spiell of how they are regulated and how they "sell" products) but in my view that is wrong and feel it is only fit and right to be up front as I have done nothing wrong apart from being "done" by someone selling me insurance I did not want, need or was appropriate.

    Look forward to hearing how to get on Longwood, if I think of things else or if something else crops up I will let you know.

    Where are you now with your claim ?

    Have you taken it to the FOS & have you had any response ?

    Would you say that the response you had from Norton was a standard reply and not actually a personal reply in respect of your own particular claim ? My response stated they were unable to obtain the recording of the telephone call did your say the same ?

    Sorry to ask so many questions, but thank you if you can help me.
