Thanks barloo,
I just had to get rid of my ex before I could reply. The cheque is in just my name, but the letter does state that he is named on the policy. I am happy to give him half if he will let me contact the csa (which he won't - he wants a private agreement) or if he will set up a regulare standing order for my son and soon to arrive second son. I think like the NCB cheque because it is to do with the home that he is current keeping up mortgage payments on that the least I can do is half the cheque.
I think he has had some legal advice (he was asking today how I got my appointment with the citizens advice people on the same day!!) and he keeps refusing to stop mortgage payments or let me pay half.
dEMIR, DON'T JUST HAVE A VERBAL AGREEMENT, IT WILL MEAN NOTHING!!! Congratulations on receiving your chq. Out of curiosity have they deducted both years 3 & 4 NCB total from your compensation ?
If so, even more seems like a miscalcualtion to me now. What do you think Busby ? (btw thanks for posting up that letter, I was otherwise engaged in Consumer rights elsewhere!!!)
Still trying to get my head around this one.
The FSCS have left it up to the individual to cancel or keep the Insurance going.
They have worked out the figure they would be entitlted to if they cancelled, but said they do not have to cancel policy.
Although FSCS have deducted this amount from the payment, if cancelled the claimant would not lose out as this would be paid by the Insurers.
I think they have done the same with the NCB and just deducted it without thinking it through, and treating the same as a cancellation rebate, which is wrong.
We all now that facs do make mistakes, and as we are the guinea pigs here(FSCS have not dealt with this type of claim before) they might just have got it wrong. In fact they must have if some who are in receipt of the NCB have not had it deducted.
I do wonder if all the case handlers are singing from the same hymn sheet, and from experience it would not surprise me in the least if they were not!!!
I'm just glad that there are some who have not received their's yet, and won't until the claim has been paid. That way they will still receive NCB.
I Look forward to the reponse from FSCSdialysis,mammamia,honey.beaniebabe,saltyfish,funky,Gumbi,Lian,doogle,oldwulf,pinknico,Halpin,alyson,Barloo,jadone,demir,netabc,chickpee,dannyboy,tomgaskel,Lozza001,sandzb,di,marshallka,pengi,lynnie,busbyh,moggy,Kim66,honestbob,tobione,itdonk,arrongborne,thunders,newtonchang,mbones,showergirl, coffeetower,hayston,sappy,dolallytap,AuntieDeedee0 -

I just think the FSCS have completely boobed on this one as they are contridicting themselves in that they are saying that you received bad advice in one breathe and then "its best to keep your insurance going as you may need it" in the other breathe. How can anyone that has use of something be given bad advice to the point of claiming it all back and using it as well. As regards the NCB then I think it totally unfair if they are deducting some peoples from their redress and then allowing others to claim it back after the redress.Still trying to get my head around this one.

Looking at this from Pictures point of view (or Target now) then I would be arguing this with the FSCS in that they found Picture guilty of so much to actually pay back all the policy but it can't have been all bad advice if they are able to use the policy.
I am no fan of these lenders but if I were them and wanted to fight back then i would with this argument. I cannot believe they have not fought back TBH as i would.
Again I state i am no fan of the lenders but I would certainly fight my corner.0 -
For everyone still waiting to hear from the FSCS, here is the update on the coming strikes........again......

Hi marshallka
Yes, they appear to have boobed good style here. It would appear the right does not know what the left is doing.
If I remember correctly honey was first told she couldn't claim, then she could and it was all very confusing.
I know initially I thought it would automatically have to be paid back to Picture, and was surprised that this wasn't the case. But as I have since found out I was totally wrong. At least they choice was left to us to use it as we will.
Do you recall anybody else who rcd the NCB and did not have it deducted from their claim. I can't think of anybody at the moment.
I'm sure the FSCS will be surprised when the letters start coming in, as if it wasn't for this site we would not know how, when or what was being paid out. They will need a good explanation for this one.
I am glad for Honey though, at least she didn't have it deducted from her compo.
As for the lenders marshallka, to be honest I don't really care at all about them, as at the end of the day, they never lose out, they will still make mega bucks in interest from those who still have loans with them. So if they do lose out, that's tough:D
I think the reason they have been trying to get people to cancel the PPI is because it will cost them less to pay out in a rebate than it would in NCB and any future claims that may arise.
It will be interesting to see what FSCS come back with regarding this latest fiasco regarding the NCB.
It is nice to hear from you again and I hope you are well. Oh and I doubt very much that you are neglecting the family;)
This is the 3rd time I have tried to submit message and keep losing it. Hope i'm lucky:eek:dialysis,mammamia,honey.beaniebabe,saltyfish,funky,Gumbi,Lian,doogle,oldwulf,pinknico,Halpin,alyson,Barloo,jadone,demir,netabc,chickpee,dannyboy,tomgaskel,Lozza001,sandzb,di,marshallka,pengi,lynnie,busbyh,moggy,Kim66,honestbob,tobione,itdonk,arrongborne,thunders,newtonchang,mbones,showergirl, coffeetower,hayston,sappy,dolallytap,AuntieDeedee0 -
