Hi I need some advise ..
I bought a oven from ikea made by Whirlpool 3 years ago in 2006 . This oven broke ( the timer went and could not function without it ) Whirl pool replaceed this one in 2007 , then 2 days ago i noticed i was feeling nausious, when my husband came in from work he asked wether i was burning anything cooking . I said no and we found that the timer knob again was giving off a horribloe burnt plastic smell .
As this cooker is 2 years old and i now can not use it , i dont have extended warentee only parts warentee.
Can I say its not fit for purpose , due to the fact its functional but the smell makes it unuseable.
Thanks for your advise

Hi , Just a little update , the first cooker we had that broke well, the letter below explains it all
I am writing because I am currently dissatisfied with the way your
company is resolving a problem with a defective Whirlpool range cooker,
and wanted to seek your help in resolving this matter.
My wife and I purchased a range cooker (appliance model 10074217) in
November 2006 from IKEA, as part of a kitchen purchase from IKEA. In
early April 2007, the electric oven stopped working so we contacted the
Whirlpool Customer Care Department and arranged for a service engineer
to come and look at the oven on 04/05/07. The service engineer stated
that the timer switch was defective, and was preventing the oven from
operating. The service engineer informed us that the switch could not be
repaired, and that he would have to order a replacement timer switch and
install it at a later date. We were told that the engineer would contact
my wife on her mobile telephone at some point during the following 7-10
days when he had received the replacement part.
As we had not heard from the Whirlpool Customer Care Department by
15/05/07, my wife rang the Whirlpool Customer Care Department and was
informed that there had been an administrative error and that the
replacement timer switch had not actually been ordered. The Whirlpool
Customer Care Department told us that they had now ordered the part
while my wife was on the telephone, and booked a provisional repair date
of 29/05/07. This was subsequently cancelled by Whirlpool, who rang us
and explained that the replacement part was still not available and then
offered us another provisional repair date of 26/07/07 (some 3 months
after we had originally contacted Whirlpool regarding this issue). My
wife subsequently requested that the Whirlpool Customer Care Department
investigate this, and we were offered an identical replacement range
cooker rather than the repair.
We received a letter from the Whirlpool Customer Care Department dated
06/06/07 (your reference: CCD/IKEA/4445642226). This letter stated that
Whirlpool had ordered the appliance, that this letter served as a proof
of purchase and that IKEA would be contacting us shortly to arrange a
delivery date. The letter also stated that we should contact the
Whirlpool Service Department to arrange installation. As several key
items of information were incorrect in the letter (our surname was
incorrectly written as "Duffey", the first line of our address was
written incorrectly as "Ivydale Avenue" and the appliance was
incorrectly described as an integrated appliance which would require
special installation arrangements), my wife again rang the Whirlpool
Customer Care Department on 08/05/07 and spoke to Debbie to correct
these mistakes. Debbie also clarified that we would not be charged for
the installation of the replacement appliance.
We then telephoned IKEA who had no record of the replacement appliance
having been ordered. We then telephoned the Whirlpool Customer Care
Department twice, only to be instructed on both occasions to follow up
this dialogue about a non-existent order with IKEA - an impossible task.
My wife e-mailed the Whirlpool Customer Care Department on 12/06/07,
explaining the situation, and Miss. K. Root from the Whirlpool Customer
Care Department replied on the same day, confirming that she had sent an
e-mail to IKEA on 07/06/07 requesting that they replace the appliance
and that IKEA usually contact the customer within 5 working days to make
arrangements. IKEA did not receive this e-mail, so my wife sent another
e-mail to the Whirlpool Customer Care Department on 13/06/07, requesting
that Whirlpool resend the e-mail to IKEA and also post us a letter of
confirmation to our home address, detailing when the e-mail was sent and
to whom. The Whirlpool Customer Care Department replied to this e-mail
stating that it is Whirlpool's policy not to disclose contact e-mail
addresses at IKEA, but that they had requested that the relevant person
at IKEA contact us regarding this as a matter of urgency. We were
instructed in this e-mail that any queries regarding this order should
be addressed to the branch of IKEA where the original purchase was made.
IKEA contacted us on 13/06/07 to confirm that they had just received the
order from Whirlpool and that we would be contacted by IKEA delivery
when the appliance was in stock, to arrange delivery. We booked a
delivery date of 26/05/07 with IKEA, and rang the Whirlpool Customer
Care Department twice to arrange installation. When my wife rang on
20/06/07 to arrange delivery, the Whirlpool Customer Care Department
told us that an installation date of 27/06/07 was available, my wife
said that she would have to arrange taking leave from work and would
ring back to confirm. When she rang back to confirm the delivery date,
the Whirlpool Customer Care Department said that as the appliance is a
range cooker it would require 2 installation operatives to fit the
appliance and that 28/06/07 was the soonest date that two operatives
would be available. The Whirlpool Customer Care Department would not
give a time, so one of us will have to book another day off work for
this.
Eleven weeks have now passed since our original contact with Whirlpool
to arrange the original repair appointment, and as I am sure you will
agree, almost three months is a very long time without an oven. This has
been especially stressful for my wife, who is 16 weeks pregnant. I have
no doubt that you are keen to bring this issue to a close in an amicable
and expedient fashion, so I am writing to request that Whirlpool
organise installation of the new replacement appliance and collection of
the old defective appliance on the same day: 28/06/07. This is because
we simply do not have room for two range cookers in our house at any
point, and also because we do not want to run the risk of injury to my
pregnant wife being caused by a spare range cooker left in the way in
our small kitchen. If this cannot be arranged for 28/06/07, we will have
no room to store the old defective cooker indoors, so we will be forced
to store it outside in our yard to the rear of the property ready for
collection by yourselves.
hope this helps the situation as i am now getting worried its all going to start again

I would say this is not fit for purpose. having it 2 years and it gaining a dangerous fault ( So much so it made me ill) Im fed up I waited 3 months for a replacement last time and I think Im entitled to something, last time they messed me about waiting for a part . I dont want this to happen again. My stress levels will hit skyhigh again as my husband took over last time ..

It's 3 years old, and clearly there is something wrong with it.
I'd get it repaired if I were you.
Why do you think someone else will come along and pay to have *your* oven fixed???"Love you Dave Brooker! x"

YEs, it may well not be of satisfactory quality or fit for purpose. However, as it is now more than 6 months from purchase, the burden of proof is on you.0

Did you originally pay by credit card? If so, you have the same rights against them.0
-
Nope , debit card . This oven was replaced by whirlpool due to a fault with the original. This is why I am angrey due to the fault with this one being the same . They have said I can get an insopection and the engineer will tell them whats wrong but again i have to pay ..
