Okay Got my reply back from Consumer direct , So pounded IKEA with info . They want me to get a report done by Whirlpool (£85 ) and get a reciept and it on paper from whilpool and then they will refund me and hopefully fix it , generally what I had to do for Argos , so we will see what happens . But 85 quid for a call out to get a quote what a rip off . Okay , not that any one is interested , but soi I know where I am upto ,.
Booked the report to be done only to be told i have to wait 3 weeks for an engineer to be available. Considering im paying 85 quid for a quote i really dont think it is acceptable.
Really dont know what to do now , I think I have some rights as the appliance is 2 years old and has a simular fault to the previous one.. Now you are getting your report done. IKEA are also promising to refund this cost if it is proved their product is faulty in the future. Well good on them really!
They don't actually have to do this! your product is beyond the 6 mths return to base standard warranty. (Loving the warantee spelling! :-) )
Your other course of action woudl be to take their product to trading standards and basically attempt to sue them for a dangerous and defective product. Do you honestly believe they have not tested/certfied ANY of their goods they sell??? they have already passed the acceptable standard for human safety!
It may be that your particular cooker had a factory defective individual issue - then the report will find this and you will receive suitable reimbursement!(Do not expect a free cooker though! you have had the use of one for over 2 years!!!!!!! you could realistically expect 4/24 or roughly one sixth of the price you paid back to you. How much was the cooker? £600? you may get £100.
plus of course the report fee of £85
Suing companies and attempting to prove negligence or defectiveness is NOT a cheap and simple process. Companies will adamantly defend themselves to protect their brand image. (Conversly this is why they also try and settle "amicably" before situations escalate)
Anyway - in brief - get the report done - pay for it - await the results -if proved faulty you are in a much stronger position for a bigger claim cos youve had to wait an additional 3 weeks to get it done! you can;t really blame the timeframe on them though, not yet! (unless they don't show up - which is a different matter!)

Your rights against the manufacturer would be determined by the terms & conditions of the guarantee / warranty. You would have to read through the guarantee to see exactly what it entitles you to.
Guarantees / warranties may be given in addition to your legal (statutory) rights, and give an alternative means of resolving a fault. It is worth noting that having a guarantee does not mean you are obliged to use it - you can insist on using your statutory rights if you wish. Using a guarantee without first approaching the trader may invalidate your rights against the trader.
Your statutory rights in this instance would be against Ikea and are governed by the SALE OF GOODS ACT 1979 (AS AMENDED) which states all goods supplied by a trader to a consumer must be of a satisfactory quality, fit for their purpose, and as described. If this is not the case, then you may have a short time (usually just a few weeks) in which to reject the goods in question and ask for a refund. After this your rights will be to claim :
1. a repair, or
2. a like-for-like replacement (same make, model, age, condition etc. although without any faults of course), or
3. a partial refund, taking into account usage.

However, if you feel that you can provide reasonable argument that the goods have failed prematurely, then you could expect the trader to offer a free repair. Anything else such as alternative goods may be offered (e.g. a different make / model) - you are within your rights to insist of the other remedies detailed above; equally you may suggest another outcome ( i.e have the goods repaired by another trader and then pursue the original trader for those repair costs).
I have discussed it with the retailer and they are helping me , I will see where we go from there ..
Before I started this I knew what i was letting myself in for , but I also knew my consumer rights ,
Too many manufacturers and retailers get away with too much because consumers have no idea what they are entitled to .
The average life span of a cooker is 10-15 years not 2 .. So I think I have resonable grounds to complain .

3. A Partial refund
this is effectively what you will get.
And I have a feeling you will still not be happy with the product once this has been effected.
I believe you are after a new free cooker. (This is only my belief - it may not be true)

I've never understood the partial refund point in cases like this. It makes no sense under contract law where damages are designed to put you in the position you would have been in had the contract been performed correctly. That would be an oven that works. So a partial refund doesn't get you to that point.0

But the oven did work? for 2 years. If it had broken immediately then fair enough.
If they do issue a refund the Op can go and buy a 2 year old oven that works with the monies received. Problem solved. The OP will receive damages to the value of a 2 year old oven. i.e what the OP's was worth (2 years old) when it failed to work.0 -

Why mess around and try to get someone else to fix your cooker?
