    'The OFT's powers
    The OFT cannot determine whether a term is or is not unfair or whether any individual consumer is entitled to compensation. It is our duty to consider any complaints about the unfairness of a contract term and if we believe that a term is unfair, we have powers to ask a court for an injunction to prevent it being used or recommended for use. However, only the courts can finally decide whether a term is or is not unfair.
    The OFT may accept suitable undertakings given to it instead of taking court action.'


    isn't the above central to problems with consumer's rights though. it shouldn't have to get to court to know if something is fair or unfair, grey or an off-shade of white!

    Now you are calling all of us who have sued CPW - I have done it successfully on around 8 occcasions, liars!


    If you have read that prargraph in that way from my previous post, then I clearly didn't write it properly and apologise. I have no reason to doubt you or the others and personally believe all that has been written by MSE members about suing CPW. I, too, lost some cash with them but wasn't a forum member at the time and , regrettably, didn't have the time to pursue it.

    What I was trying to say was that I had no personal experience of suing CPW and, since what followed could be held to be libellous if it was not true, I was attributing the fact that they were thought to be dishonest to those who had, indeed, had to take them to court.

    I reproduce the offending paragraph below so you can re-read and I think the first line and a bit shows you where I stand.

    Again, sorry if it came over that I didn't believe you.
    Now, I believe that there was a real culture with two of the other CPW trading companies to deliberately and, if you believe this forum and the evidence of the cases brought, won or settled out of court at the last minute, dishonestly withhold valid payments to customers in the hope that they would go away or give up.
