dont know if he claimed he didnt get that shirt (he bought 3 of those shirts and is selling ALL OF THEM ON AS NEW!!) but im guessing he did!

For starters, you could try opening up a non paying buyer dispute (now you've refunded...), and point out to ebay that he DID receive it, as he's quite clearly selling it!!
Would it be worth leaving +ve feedback (as you can't leave -ve) saying "shame the item didn't arrive..." - just incase he tries this trick with other people. When people are suspicious, they DO start looking what the positives say. EDIT - I see you've already done this!Should've = Should HAVE (not 'of')

I hope everyone affected has put in a claim with the RM!
They will start their own investigations if there are a lot of items going missing to one address.My TV is broken!
