Fined for illegal plates!! Appeal??

Okaaay, after trawling through the Road Traffic Offenders Act, I can't find any loophole which invalidates the FPN as the amount of fixed penalty has been stated (even in manuscript) and there is no requirement for the notice to be issued in person. Furthermore, an FPN is "a notice offering the opportunity of the discharge of any liability to conviction of the offence to which the notice relates by payment of a fixed penalty" so it really wouldn't be in your interest to even try to invalidate the FPN as it's intended to save you from a more expensive prosecution. You cannot be convicted within 21 days of the date on the notice, so let's hope it arrives fairly soon by post.Hi Dave, he crossed the old price of £30 out on the ticket he was writing on (a pad of them) he said he couldn't give it me as it was the wrong amount. Any hope now lies with the nature of the offence, rather than the FPN.

An FPN isn't going to be used in evidence, so any minor errors or amendments to it are irrelevant.
It's up to you if you want to fight it, but you'll be up for a larger fine, costs and victim surcharge if you do. I

Re the paperwork, I don't beleive the officer needs to give it to you on the day (it would be silly to have offences go unpunished because say the officer had run out of the correct forms to give to the offender), so tehy can give you a verbal notice, with additional paperwork to follow.
I'm guessing if the change went through recently he's either ended up picking up a spare pad of the old type, or been given it and not thought to check it was the latest one, thus he can't give you it on the day.
I don't honestly think you've got much of a leg to stand on as the rules for number plate logo's are very clear (and I beleive haven't really changed in a while).
If the op is lucky he'll just get a "fix it" notice (vehicle defect notice?) which I beleive is an option the officer has in some cases, as it means he can get the plate changed to a legal one then present proof at his local station to avoid the fine.
One thing that does occur to me, if the op has a personal plate, I beleive the DVLA now have the option to recall it if someone breaks the rules in regards to displaying the registration mark repeatedly, and given the cost of some of those plates it's not something i'd risk.
Which reminds me, I'm going to have to have words with my sister if the police are cracking down on the plates, as she's got a playboy bunny logo on hers, something i'd told her not to get when she bought the plates.
There not personal plates, just have a logo on and letters are a little larger than normal. Still very clear to see, but yes still illegal!0 -

also, these rules were learnt when i was doing my test years ago, i copied this for your info:
What you must not do with your number plate...
The law states that:- You must not alter, rearrange or misrepresent the letters or numbers
- Characters must not be moved from one group to the other (e.g. A242 ABC must not be displayed as A242A BC).
- No stylised letters
- Don't move the space around
- Don't misrepresent letters / numbers using screws or fixings
- Don't misrepresent letters / numbers using squashed or distorted letters
- No images other than the approved flags (no football emblems, etc)
thanks Dave, I think the only thing wrong with them looking at the above is that they are stylised letters. They are a kind of bubble writing but slimmer if that makes sense!! KA09 ZYP something like this but a little fatter!0 -

Thanks again Dave, after your advice I think I will just pay it when it arrives. Prob not worth the hassle! but maybe I just won't pay my insurance next year and get fined a quarter of the price, or maybe sell drugs and to pay for it and get fined about £50...lol only joking but those are the things you see daily!! how frustrating :eek:0 -

The plates that are two letters, two numbers are fine - cos they look nice, but the ones where people try to make TR58ACY or BA58RRY - they are the ones who need to be force fed plum tomatoes!
