strange Tesco experience

    Crikey,I had better be carefull next time I am in tesco,I often forget to take my specs with me and end up getting my 7 year old to help me select a wine to take to the in-laws for sunday dinner as I cant read the labels with no specs on(blind as a bat).They might think the 7 year old is choosing it for herself!OMG I even got her to choose a bottle of whisky for her dad for fathers day.She picked one in a nice shiny red tin as its her fav colour,I didnt even consider anyone may think it could be for her.

    It does all sound a bit O.T.T. though.I would be mortified if they refused to sell me a bottle of wine.

    No, a parent cannot make a proxy purchase:

    A parent contracts the sale in his or her own right, and is not acting as the child's agent or go-between to effect the child's own purchase.

    The REALLY daft thing about this is that they still wouldn't be able to sell you the wine even if your sister had ID!!! (by their rules).     Your sisters ID - if she had it with her - would clearly show she was 13 and they would presumably have refused to sell it to you while she was with you on the assumption that you might be aiding and abetting her alcoholism! So what on earth is the point of asking for her ID - it doesn't nake a blind bit of difference! Surely, it only makes sense to ask a customer who is buying alcohol for ID to prove that they are above the legal minimum age to buy it? You clearly weren't trying to tell them your sister was over 18 so the whole exercise was ridiculius.

    So all I need to do then, is take my baby's Birth Certificate with me when I go shopping for alcohol. Thank you. Glad we got that cleared up.

    And if you'd read my next post, you'd have seen that in the eyes of the law (and the laws this discussion is pertaining to) if an adult says that a child is their son/daughter and there doesn't seem to be anything to contradict this (i.e. taking both their ages into account) the sales assistant would be able to accept this as fact. If it then turned out NOT to be the case, then the assistant couldn't be held responsible...

    This exact scenario happened to my DD a few weeks ago, she went to Tesco for food for a BBQ, she is 22 and she was with her BF's brother's GF who is over 18 but had no ID with her.

    DD had £60 worth of food and other stuff, she was paying and she had two lots of ID, she made the serious error of judgement of trying to buy two bottles of Pear Cider.

    Check out op said it was a new law, DD queried law, maybe store policy? Supervisor came and backed up COO until DD pointed out she was an off duty PC and if they wanted to refuse to serve her due to store policy that was fine but to quote a non-existent law was pushing it a bit, eventually a more senior manager arrived and apologised for the misunderstanding by his staff of a new store policy and as DD seemed like a responsible young adult they were only to happy to serve her. DD said she was tempted to leave it all on the till and go to Asda but as it was red hot and she had already got everything she needed she paid and left.

    Last year she got asked for ID to buy a bottle of Jack Daniels BBQ sauce in Tesco.

    Infact, if we are going to get picky, surely a retailer could infact get in trouble for NOT selling alcohol to a parent who intended to give the alcohol to a child. After all, it is a parents right and responsibility to say how their children should be brought up, which includes being in charge of ,and saying, what they can and cannot do. Family Law Act 2006.

    Or is that just taking it one step too far?? lol
