Last weekend there were two stories about scam firms conning school kids to sign up for expensive texts and sending messages to pensioners that led them down the path of sending and accepting expensive texts. Both of them fell foul of the regulator and their directors are having to put their hands in their pockets for sums with lots of zero's on the end.
Unfortunately the interweb seems to be cowboy country and Mr Plod is slow on the uptake outside of the square mile.

hi again, fyffes i have had no reply to my email, or telephone call etc, what do you think i should do now? i had the confirmations that both emails where delivered and read the day after i sent them! ??? zoe0

still heard nothing so resent the original emails with a covering email stating they now have 48 hours to reply with proof of agreement and if they cannot do this then i will be expecting a cheque payment etc. cant believe i havent even had an email to say they are dealing with it!0

Personally I'd keep harassing them on a daily basis from now on. You've been patient and they just ignored you. In theory they would need to prove that they dealt with your complaint fairly. Ignoring your complaint clearly isn't attempting to resolve the complaint is it.
So I'd keep bombarding them with emails referencing the previous attempts at communication which they have chosen to ignore. Surely they will have to respond if they are made aware that you are logging each and every email they ignore? When you take into consideration the fact that they themselves seem to believe that just saying they sent a welcome email is legally valid, they should therefore respect somebody who actually takes the time to actually accumulate factual evidence against them.0 -

so i sent this
I haverequested proof that I pressed buttons to confirm agreement so if signing up toyour offer meant doing this I want proof that I did it. I have never had anyemail to the address provided of this nature, so am yet again requesting proofor a screen shot of my acceptance of your terms and withdrawals from myaccount, if you cannot show me where I agreed to the sign up process (that's menot a generated welcome email which I would also like proof u sent to me and wasreceived by myself) I am again requesting full refund. Also please note thisrequest is for full refund, I have spoken to my local police and CAB who areworking alongside me now, they have asked that I request formal documentedproof of agreement (which I have three times now) saying that buttons need tobe pressed is not formal documentation, so as i have been advised I amofficially requesting this now. All correspondance is being copied and savedand viewed by the people I have now involved in this matter.
so what should i do next, there complaints thing says i should apply in writing to the team leader etc.. thanks fyffes again!

Zoena, I can only tell you what worked for myself and what I've heard has worked for others. Hopefully somebody with more knowledge than me will pop up soon.
Basically that email they sent to you is the exact same template email that they sent to me in the first place (and seemingly to the majority of other complainants). So I just carried on demanding legally valid evidence as you already have.
In my opinion the entire matter revolves around the following quote:To become a member you had to confirm your email address, tick that you accept theterms and conditions and then submit your application by pressing the buttonprovided. Without following these steps it is not possible to become a member.
I emphasised the fact that effectively just saying that you "wouldn't have been able to become a member unless you'd agreed to it" is a claim which they need to substantiate with actual evidence. And if they did have any evidence they would undoubtedly have provided you with it just to shut you up wouldn't they? So the logical conclusion is that they have no evidence and they're just trying their luck and hoping you'll accept it and go away (presumably many victims have done exactly that over the years).
So basically you're still right at the start of your battle. If you want your money back you'll have to force it out of them as they won't give in easily. I think I recall beginning emails with a demand that it is forwarded to a senior member of staff who is able to sufficiently deal with my complaint without the use of template emails. And of course I included the warning that I have compiled records of every form of communication thus far (inclusive of emails which they chose not to reply to).
Anyway, just keep up the good work and let us know if there's any developments. It's been a while since their last telling off by the OFT so they may well have altered their practices accordingly by now.0 -

so i have re mailed them today saying it is over the 14 days so wheres my response, they did send a letter that was dated before the email was sent still only offering the 6 months worth back so i have ignored that and continued through email etc.. the letter wasnt sent recorded etc.. so will wait and see what response i get as surely they are supposed to get back to me within the 14 days etc?? nightmare lol! thanks again0 -
