Do Rewards Now (Adaptive Affintiy) consider themselves to be above the law?
Rewards Now say:We do not have the facility to capture your information when you first input your details into the registration form. The only information we can provide is a sample of the screen shot that was completed in order to activate your membership.
However, the Electronic Communications Act 2000 says:

It's simply incredible isn't it.
You have made a formal request via both email and written letter requesting actual evidence of your enrollment with their company. They have responded to this request by providing absolutely no evidence whatsoever in the blinkered belief that this is somehow sufficient in proving the enforcement of the membership legal?
You specifically told them in advance that you require actual evidence and not screenshots of template emails. So how do they respond to that? By sending you screenshots of template emails of course. It's laughable.
In their response to myself and Sv03 they made the following template statement:
"We do not have the facility to capture your information when you first input your details into the registration form. The only information we can provide is a sample of the screen shot that was completed in order to activate your membership."
So there we have it. An admission in black and white that they hold absolutely no evidence whatsoever. Yet despite this, they see no reason why they should refund your money? I'm starting to think that the office staff at that company really haven't got a clue what to say or do when a response is required to an issue that their boss hasn't already written a template reply for.
Now I'm no legal mastermind but when money is taken from your bank account and put into somebody else's without any evidence of legal authorisation, this is theft. Wikipedia defines theft in the following way:
"In criminal law theft is the illegal taking of another person's property without that person's freely-given consent."
As I've stated earlier, customers are not asked by rewardsnow to enter any personal details other than their email address on their own registration form. Despite this glaring lack of information, they miraculously obtain access to your name, address and bank details from a third party. The question is, what is to stop them activating your "membership" whether you accept their terms and conditions or not? They clearly already have access to your details from the third party so there really is nothing to stop them doing this if they wanted to.
Given the indecisiveness of rewardsnow's signing up process, you'd presume they ensure that they store the data which proves beyond doubt that everything has been done legitimately. But then again, why bother collecting evidence when you can simply shrug your shoulders and say "we ain't got any guv" and think that's sufficient in proving the legality of an online membership. It's simply unbelievable.
It's time the OFT took some proper action against this company. They've been warned in the past yet they just stick up two fingers and carry on operating in a manner which could be interpreted as illegal anyway. Anybody wishing to add their complaint to the presumably huge pile should do so via this Directgov link. It's common knowledge that this company trawl forums looking for nasty people who say horrible things about their angelic little company and demand their deletion (hence the amount of interventions by moderators). But before they get on their high horses and demand the removal of certain statements I'd like to ask them one question.

Just seen my bank statement & noticed 2 payments 4 £19.95 to the above companies. I do not know who they r or what they do & have no idea how they managed to het the money out the bank.
I will b phoning them in the morning to find out more my bank won't do anything until I have spoken to them.
I'm fumming surely this is totally illegal & there must b something that cam b done by one of the financial omnibu:mad:s services.0 -
RewardsNow have caught me too, luckily I checked my statement, the annoying thing is I do remember enrolling and as soon as I received their email stating it would cost me £19.95 per month I used the online option to cancel the account as I could see straight away it was a waste of money.
Having seen they took the money anyway I have today logged on and cancelled a further 3 times, each time I see this message:
Your membership cancellation request has been sent.
Please allow up to 2 business days for the cancellation to take effect.
You have been sent a confirmation email.
I've not however received a single confirmation message and have notified them that it looks like they have an issue with their online cancellation button and requested a refund, no doubt I will get the same useless responses everyone else has received.
I did received the automated response that states it will take them 2 days to read my email that I'm blocking the emails as spam.
Just glad I caught it early on.0 -

There are two companies working hand in hand to gain access to your bank account here. Are you sure you've cancelled membership with them both? Cancelling the membership with one of them doesn't mean the cancellation will apply to both companies (even though they're in the same office in Edgware). They will gleefully tell you this further down the line if that's what's happened here.

I would urge everyone caught out by this scam to contact Consumer Direct. 08454 04 05 06.
I have contacted them & they have given me advice about how to try to get my money back & have passed on my concerns to Trading Standards, so the more people who complain the more likely there will be action taken.0 -

GOT A FULL REFUND!! I BOMBARDED THEM WITH EMAILS DAILY, THE LAST AND FINAL LETTER. Although i am pleased i got my full refund, however still think it is disgraceful that they are probably getting away with it with so many other ppl!!

Once again rewardsnow have declined an opportunity to provide evidence that they are operating in a legal manner. Can't think why that is. I love the way they just didn't mention your request for evidence and instead just refunded you. Why do they think a refund automatically means you no longer wish to see some proof?
I'd like to think the individual at rewardsnow who challenged you to define what you considered to be "legal proof" is currently devouring a slice of humble pie. And hopefully there's enough left over to share with the "you should've read the terms and conditions" brigade too.
Thanks for posting your story on here. It helps to know if they've changed tactics or their conduct (they haven't by the way). And it will also help people to have the confidence to deal with this company. Particularly those who lost large sums of money, many of whom could be inclined to "accept it and learn from their mistake" as advised by forum bullies (another slice of humble pie chaps?).
It's time the OFT stopped treading on eggshells with this company and did what needs to be done to protect the decent people of this country. If a company is doing business in an illegal manner, this should mean that every single penny they've ever taken from everybody should surely be refunded and the operation shut down?
