    Oh and they will let me pay my deposit when I go down - so I need to start saving - £386.05 - any spare pennies anyone:confused:

    Morning boys and girls:hello:

    Nothing much in the post today other than a letter from HBOS Visa. I laughed out loud as I read through the letter and got to this bit:laughing.gif

    "Under the Consumer Credit Act 1974 we are required to give you this notice as you have failed to make the full minimum payment in each of the last two months..........."

    I will write to them bringing their attention to the fact that "under the Consumer Credit Act 1974, they are obliged to provide me a true copy of the executed agreement on payment on a £1 statutory fee..............they haven't done this which is why I haven't made my full minimum payment - under the Act of course!falldownlaugh.gif

    I'm going to enjoy writing this one :rotfl::rotfl::rotfl::rotfl:

    I've probably got the 5 pence bit going spare:confused: :rotfl:. Good news on sorting the accomodation out though.

    Just wanted to share with you all my HBOS Visa response..........

    ACCOUNT IN DISPUTE.
    Account Number 4560 XXXXXXXXXXXXx


    Thank you for your letter of 23rd September 2009 received 2nd October 2009.

    I note that you refer to the Consumer Credit Act 1974 and your obligation to provide notification that the full minimum monthly payment on the above account has not been made in 2 months.

    I refer to my letter of 10th September and the constant written communication since 30th June 2009. You will be aware that YOUR obligations under the Consumer Credit Act 1974, require that you supply me with a true copy of the executed credit agreement upon request and payment of the required £1 fee. I paid this fee, and yet you have been unable to provide a copy of said executed agreement. As you have been unable to meet your obligations under the Consumer Credit Act 1974, I have the right to withhold payment until said agreement is produced.

    Despite clearly identifying what action you are able to take whilst the account is in dispute, you continue to levy charges and interest. I hereby write to give 14 days during which you are required to remove all charges and interest which have been added to the account since it was placed into dispute on 21st August 2009. If you do not comply with this, I will proceed to lodge a complaint with the Financial Ombudsman as you will have breached your obligations under the Consumer Credit Act 1974. To clarify you will have until 16th October to action this request.

    Furthermore, I note you have previously declined my request to remove detrimental information held on my credit record in relation to this credit card account. You will be aware that the consumer credit agreement is the very document which, when signed, gives consent to the processing of my information. As you have been unable to locate this executed agreement, you are not in possession of my alleged consent to the processing of said information. Therefore, you do not have the right to share this information with any other party. It is my intention to pursue this matter under the Data Protection Act if you do not remove this information within the next 14 days.
    If you are unable to provide a true copy of the executed agreement, please confirm this in writing within 14 days. I request that until such times as you are able to provide a copy of the alleged executed agreement that you do not communicate with me further. Further collections activity including letters requesting payment on this account, will result in a complaint to the Financial Ombudsman and the Office of Fair Trading, as this contravenes the OFT Debt Collection guidelines. I look forward to your urgent response.

    A week on Sunday I'm off! I think its the 18th October - that depends on getting my registration through by then - but the Uni expect I should receive it in the next 7 days - eek:eek: - I'll be a real midwife:rotfl::rotfl::rotfl:

  • Hi, Well done on the letter. I think its ace. These big companies always try to imtimidate their clients with "scary" terminology so i thinks it great that your going right back at them! XX
