    Well done Gargrave. Can't believe how brave you are doing this yourself.
    Am seeing how things go with cccs for time being regarding creditors. But am fighting for credit card charges and ppi's. Letters sent today by recorded delivery asking for amounts plus interest (total over £1100), so fingers crossed. Have sent letter to Mbna threatening them with Information Commissioner as 40 days was up on Monday and still not received charges list or statements.:mad:

  • Morning all,

    Well we had a christening on Sunday and have been DIYing most of the weekend to get jobs finished around the house which have sat there for years!

    Not as productive as we hoped, but we are resolving to finish them on Friday!:p

    Anyway in terms of debt-busting - well a mixed bag.

    I had a letter from Lowells re: one of my shop direct accounts at a staggering £3260.24:eek:.

    It basically states "We refer to your recent request for a copy of the original credit agreement for this account. After liaising with Shop Direct in an effort to obtain this document we have been advised that it is no longer available due to the length of time since the account was opened with you. At this time we have closed our file............blah blah blah".

    Now, I am confused on this one but happy for them to call the dogs off. I think this is the one which when they sent out a new CCA when changing all their account numbers over in 2008 I signed it stupidly and they provided a copy of this. I have proof the account was opened before then of course, but I thought I was stuffed with this one.

    Should I take it this one is unenforceable - I'm sure Shop Direct still send me statements - must check this one out.:rolleyes:

    Just popping in to catch up.

    When I read the above I thought you had been on the wine and were 'dying' all weekend - not DIYing:rotfl:.

    I read your post on the CCA updates re Lowells - if they don't have the agreement I would say nothing and see what happens - I certainly wouldn't contact them to make them aware of your confusion:p.

    Whens the new job start and what about hubby's is he settling in?

    All quiet with me - just defaults coming in. DCA chasing me re MBNA and the dreaded Sky idiots but I fired off a harrassment letter so hopefully they calls will cease for a while.

    I have been provided with no CCA on the requests that I made but I have a query with the stuff that Sky sent me.

    I have not been around for a while but have just caught up with your battle.

    I must congratulate you on your strength and courage this is a great example to anyone who has debt problems.

    I am one of the lucky one's in that my brush with the deadly disease of debt was over 30 years ago. At that time (you may not believe this) it was difficult to get into debt. In fact credit cards were not offered weekly in the post. In those days or so it seamed you had to be someone who did not need the money to borrow money!!!! So my debt problem was easily solved in a reasonable period of time and I have been debt free and lived within my means ever since.


    Your daily boxing match of punch and then counter punch has made me ask this question.
    Who opens and reads the letters at the other end. In fact do you think anyone reads them. If the "debt" department has 50 people employed in it and they get 1000 letters a day when do they have time to read a letter. How long is the backlog. Do they care, have they time to care.
    Do you think that a file exists where they put all your letters in. The letters that are sent to you, do you think a copy of them is put in your file.

    I begin to wonder if there is a file that it only holds your letters, therefore showing only one side of the story.
    Do you think there is any value when you reply of sending a full set of the correspondence each time.
    Are you sending letters to a human but they are powerless as all letters sent out to you are computer generated.
    How do we get someone's attention.

    Any thought on this?

    Hi Gargrave, glad things are going relatively well. Got my 1st claim off Abbey under the financial hardship ruling, was surprised as I had no priority debts but they have sent back last 12 months charges as a goodwill gesture, and have said they will be in contact regarding 6 years of bank charges once the court case is over. Not bad for 2 letters worth of work. Looks like I'm learning good things from you. X

    Have decided to keep my confusion to myself - have realised that recently I haven't received any statements for the Lowells account from Shop Direct - so the plan is to ignore this debt for the time-being following Lowell's response, and see what becomes of it all:eek:

    Things are fine - called the accommodation office to get sorted as I hadn't heard anything - it seems they don't have my form despite sending it 6 weeks ago:eek:. This means they don't have accommodation for me until the beginning of November and I'm hoping to start between 11th-18th October.:eek:

    It could only happen to me:D

    Hubby settling in to his job, but we are still skint. Bring on the overtime please somebody!:cool:

    Sounds like you have sent off the right letters to those Sky idiots - keep at it!

    I'm ebaying like mad - I reckon if you look at all of the items listed on ebay currently 55% are being sold by me;)

    Nice to have you along - hope you are well. Thanks for your lovely comments, I never set out to be an example - more an exercise in public humiliation to spur me on to get rid of these horrid debts:rotfl::rotfl::rotfl::rotfl:.

    I am under no illusions - I doubt for a moment they are shaking in their boots when they see my letters coming. Do they bother to read them - I doubt it - otherwise they wouldn't send me these inane replies which bear no relevance to the letters I have sent:rotfl::rotfl::rotfl::rotfl:.

    The reason I have sent copies of earlier correspondence is for my benefit in order to ensure I can prove my paper trail exists and that I am backing up every "punch" I throw. Without Martin and the wonderful people on here who offer advice and support (Tixy, Rog2, Stapeley, GeorgeUK, Blue Jeans, Jodan and everyone else - too many to mention) I would never have had the courage to begin this, and finally I am beginning to see the benefits. I will continue to fight as I have no other option. I am at last taking control - bit by bit.

    P.S. If my file does exist - it should be bursting at the seams at each and every creditors office. I am probably costing them more in storage than I owe them :rotfl::rotfl::rotfl::rotfl:.

    How do we make them listen? If I had the answer I wouldn't be slugging away day after day, however sometimes it pays to go to the top. I had a great success with Littlewoods by contacting the Chief Exec's office and copying them on the correspondence to date. We all share ideas - and we will get there:D
