I will correspond with you only in writing whether that be by post or email – I am happy to be contacted either way. I will not be contacted by telephone under any circumstances and request that you remove any contact telephone numbers from your system. I do not wish to make an appointment with any of your representatives and therefore, you will not be permitted to send anyone to my home address or threaten a “home visit”. I would direct you below to the appropriate paragraphs of the OFT guidance quoted.

I have made countless requests to Barclaycard over the last 2 years, and as yet they have been unable to supply a document which satisfies the requirements of a valid CCA. They do however, send on a fairly regular basis a copy of an application form and a current list of T&C's. You will be aware that this does not fulfil the requirements of my request.[/FONT]
    [FONT=Times New Roman, serif]To summarise, I have set out my accepted means of communication between ourselves. On receipt of a true copy of the original Consumer Credit Agreement containing all prescribed terms which make the agreement valid in court, I am happy to enter into an agreement to repay the amount suggested I owe. Until I am in receipt of the documentation which satisfies the above criteria, I will not enter into further correspondence with you.[/FONT]

    Thank you for your recent letter in response to my full and final offer of settlement. I note that you have declined £306.00 as a full and final settlement, however have made a counter offer of £329.24 to settle the account.


    As you did not respond to my original offer within the time frame stipulated, I did (as indicated in my offer), withdraw the settlement offer and used the funds on loan to me to repay another creditor. This means that I am unable to make a lump sum payment of £329.24 but could afford to repay this amount over 12 weeks by standing order at £27.44 per week every Friday. I wish to clarify this is offered as an ex-gratia payment in full and final settlement of the account. This offer is made on the clear understanding that, if accepted, neither you nor any associate company will take any other action to enforce or pursue this debt in any way whatsoever, and that I will be released from any liability.


    I also request that, if accepted, you will make an entry with credit reference agency files relating to the above account as having been paid and the account closed.


    I require your written agreement of this offer and schedule of payment within 14 days. I will also require payment details to commence standing order payments. If you do not reply within this timeframe I will withdraw the offer of payment and conclude that you have found this to be unacceptable. Please note without your written agreement of this offer and its terms, payment will not be made.

    Haven't heard from Wescot either - and the 14 day deadline expires 7th November. On the plus side it means I can definately have this sorted one way or another before I head back to London. Hopefully they will accept 12 weekly payments and I can start making headway with this :D.

    Heading off to take Cole to his football training (2 hours standing in the lovely Scottish weather), should really make an effort to start listing some ebay again after the fabulous result last time. But in truth, I'll probably be knackered - a job for tomorrow instead :D.

    I had another telephone interview from Oz today - and bingo! Offered it on the spot! Delighted :D:D:D.

    They are offering me sponsorship and will start the VISA application once they receive my references.

    Having a wonderful day :D.

    Just received a letter from my new friends at Lowell Portfolio. I can tell they love me.

    However, they have confirmed they have noted my request and that all future correspondence will be in writing as requestd, and no doorstep collectors will call on me without my prior permission (no thank you ;)).

    They also noted my comments re: CCA from Barclaycard and they have queried this with Barclaycard and will get back to me :D.

    They :heart2: me.

    Also got a letter from Wescot - on the surface a good result. However.................

    They are accepting my 12 weekly settlement payments of £27.44 per week commencing 12/11/11. However they refer to my recent communication enclosing an offer of £329.24 in partial settlement. No, no, no. Rewind that back. Letter heading off to my buddies at Wescot today stating that I did not make an offer in partial settlement and that in fact the offer is in full and final settlement.

    I will of course post my response for your entertainment :D.

    Planning to get my finger out with ebay today. Have decided not to take our furniture or car with us - saving a huge amount in the short term (which although short sided is what will allow us to get to Oz and be in a better starting position). Instead will rent a holiday rental (furnished) for 6-8 weeks while we find a longer term rental and will buy Ebay etc to furnish a rental cheaply.

    So look out May time I'll be ebaying most of my furniture :D.

    Also going to get ladylike hair removal today before my hubby comes home to a chimp.

    Thank you for your letter of 31st October 2011, received today.


    I note you refer to my offer of £329.24 in partial settlement of the above balance. I would refer you to the terms of this offer (copy of original letter enclosed), and clarify that this offer is made in full and final settlement, not partial settlement. Partial settlement implies that the remainder of the balance will still be due, and that I will still be liable for the remaining balance.


    I have offered to commence weekly repayments as agreed from 12.11.11, and in order to keep to this timescale I require your written confirmation of my implicit terms. Without receiving your detailed acceptance of these terms before this date, I will be unable to commence our agreed repayments within this timeframe.


    I require written confirmation implicitly detailing the following points:


    • following receipt of £329.24 in 12 weekly instalments, neither you nor any associate company will take any other action to enforce or pursue this debt in any way whatsoever, and that I will be released from any liability.
    • you will make an entry with credit reference agency files relating to the above account as having been paid and the account closed.
    • £329.24 is offered as an ex-gratia payment in full and final settlement of the account.


    Please also include in your written response your bank sort code and account number so that I may arrange a standing order. You have asked me to call an 0844 telephone number to arrange a standing order, however you will be aware that this is a high cost number which I have no intention of bearing the charge for. You can of course provide me with these details in writing. I will only be able to commence payments on 12th November 2011, on receipt of a letter which satisifes the above criteria.
