Littlecat I am afraid 1Jim is right in what he is saying. I understand that you must feel very upet about this whole thing and still think it could be worth getting some advice on this matter, its worth a try!. If you had only mentioned this at interview and explained your circumstances then things could have been different.to be fair its not a minor problem.....you drove without insurance and then failed to attend court to answer the charge (presumably you knew the summons was coming from when you were caught)...this suggests a dishonesty from the start....further worsened/reinforced when you failed to declare this on your application form.... I can see your point of view but look at it from a ward managers point of view..what would you do in their situation?

If i had read the forums then YES i would have known but seeing as i did not then clearly NO0

In all honesty if it was their one and only conviction and seeing as they had been in the job 3 months and had nothing but exceptional reports from co workers and patients then i would look at the conviction an assess if they were a threat to people, if not then a probationary period, or look back at the number of years they were with the company and see if there had been any question on their personal ability or reports of dishonesty, it really was not deliberate at all
If you were an NHS manager, you would not. You have been dishonest, do you honestly expect them to let you near patients with this knowledge?Gone ... or have I?0 -

And if they had been employed by an existing employer that may be the case as they would know you and would be able to make a decision based on more than the bare facts
But
They did not know you before they employed you
They Know that you lied on the application form
They know that you drove without insurance
They know that you failed to turn up to court to answer the charge
They know that you have been off sick in a new job
Its very hard to continue to employ anyone knowing the above!
If you had read the application form, understood that ALL convictions had to be declared, understood that an enhanced CRB check would show up everthing in your past and then compleed the form correctly you would have had a chance to give your side of the story, this would have shown a level of maturity and professionalism that they could respect! I know of several people working in the NHS who have convictions for more serious things but they have always been honest and upfront about the situations relating to these convictions. Im afraid its all about honesty and unfortunatly you wernt0 -

I wouldn't say dishonest as i did in no way deliberately lie as that is not my nature, if i really thought it was still there then i would have been upfront but i genuinely thought it had finished when the ban finished0 -
I wouldnt have gone sick within 3 months of starting!0

Does the application form say something like have you ever been disqualified from driving then the answer is yes, just because the fine was paid and its 3 years old it doesnt make it vital0

so she told you she was going to seek advice about this...so you had some warning,... you then went off sick and were suprised to be called in...how long did you think you could stay off for before facing the music?0
